The publication provides a comprehensive analysis of the state and development of national education over the 30 years of Ukraine’s independence, identifies current problems in education, ascertains the causes of their emergence, offers scientifically reasoned ways to modernise domestic education in the context of globalisation, European integration, innovative development, and national self-identification. У препринті на підставі системного осмислення теоретичних засад підвищення дослідницької спроможності університетів України в контексті імплементації концепції «Відкрита наука» розкриваються провідні тенденції та основні наукові підходи до розв’язання таких проблем, як: загальне й особливе в інтеграції освітньої і дослідницької діяльності університетів в умовах відкритої науки; політика і процедури імплементації концепції «Відкрита наука» в університетах; теоретичні основи підвищення відповідальності дослідницької діяльності університетів; інструментарій відкритої науки як механізм трансформації дослідницької діяльності університетів задля досягнення цілей стійкого розвитку; демократизація наукової діяльності як засіб підвищення дослідницької спроможності університетів України: ціннісні виміри; формування правового та економічного забезпечення дослідницької діяльності закладів вищої освіти; оцінювання дослідницької діяльності та публікаційної активності університетів; розвиток університетської дослідницької інфраструктури. Аналітичні матеріали адресовані представникам університетської спільноти, усієї когорти наукових і науково-педагогічних працівників закладів вищої освіти, академічних, наукових організацій та установ, фінансуючих структур, громадськості, а також публічним службовцям різних гілок і рівнів влади, що опікуються науковою і науково-технічною діяльністю та вищою освітою в Україні.
An important feature of the development of modern science is the increasing spread of open access to the results of research activities. The article provides an analytical review of the spread of open access to scientific literature in the world, identifies the reasons for this phenomenon, examines the problems that stimulated the emergence of the Durham initiative are considered, reviews the situation with access to scientific legal literature in the early 21 centuries. The main arguments of both supporters of open access and critics of the movement are identified and analyzed. The main development trends are identified. Recommendations have been developed on the introduction in Ukraine of measures to support open access to legal publications.
The problem of applying the concept of “recovery” in modern European legislation and related analytical documents of a descriptive and recommendatory nature, prepared by groups of experts, is investigated. Variants of the use of this term, differences in their “legal content” are analyzed. The pan-European post-covid recovery program of the EU member states is implemented in European legislation in the form of an operationally prepared set of documents that include a special toolkit (mechanisms and tools) of legal regulation of this process. The effectiveness of its implementation is, first of all, that the special legislative support created for these purposes is based on the norms of European legislation that have already been worked out in practice over many years. Secondly, by clearly establishing a single methodology of national strategic planning for recovery, the general framework of its goals and procedures. A single strategic planning tool in the form of “Recovery and Resilience Plans” aimed at mitigating the economic and social consequences of the Covid-19 pandemic has been applied for all EU member states. Thirdly, the formation of a new global, European and national model of the executive structure, which includes special institutions with appropriate lists of functions, changes in the rights and duties of public authorities. Fourth, realism, confirmed by practice, provides a financial mechanism for long-term attraction and distribution of funds, which cannot be implemented without ensuring the confidence of investors. Fifth, political support on the part of civil society institutions. The model also includes a set of state-citizen initiatives in specific areas and proposals for the development of a new toolkit of public-citizen management, which as a whole will form the basis of new “social contracts”. The set of available legal and expert documents of modern European legislation on the problems of post-covid recovery, the set of initiatives, tasks and risks defined in them, allows us to draw conclusions about the possibility of its application when working out the general contours of the concept of post-war recovery of Ukraine.
Regulatory and legal framework for the implementation of control functions in the committees of the Ukrainian Parliament is considered. The list of tools of control functions is summarized: hearings in the committee, consideration of control issues, conducting “round tables” and field meetings, etc. Peculiarities of legislative support in the spheres of education and science as an object and subject of parliamentary control are analyzed. The work practice of the Committee of the Verkhovna Rada of Ukraine on Education, Science and Innovation in the implementation of control functions during committee hearings was studied.
