Résumé Les États qui ratifient les conventions internationales de l'OIT ne sont pas les seuls à se conformer à leurs dispositions. D'autres aussi adaptent leur législation en conséquence pour renforcer leur légitimité. S'appuyant sur une nouvelle base de données longitudinales, l'autrice retrace l'évolution des dispositions concernant le congé de maternité dans 160 pays entre 1883 et 2018 au regard de l'adoption par la Conférence internationale du Travail des conventions relatives à la protection de la maternité. Elle constate qu'à la suite de cette adoption tant les États ratificateurs que les États non ratificateurs ont élargi leur régime de congé de maternité rémunéré.

Comparative welfare research commonly assumes that women’s political demands were not a crucial factor in the early development of welfare legislation, given their limited access to political resources. This article argues that women contributed to enhancing their right to maternity protection once paid maternity leave was adopted. The early development of paid maternity leave was not only an outcome but also a cause of women’s influence in policymaking. Although paid maternity leave was invented by male policymakers in pioneer welfare states, the adoption of paid maternity leave generated political opportunities for women to push for further expansions. Utilizing an original historical dataset of paid maternity leave, I examine the adoption and extension of paid maternity leave in 20 Western countries from 1883 until 1975. I find that women’s political participation shaped the generosity of paid maternity leave but not the timing of its adoption.

Previous research focuses on the question of whether international standards have prompted any improvement of labor and social standards by law or in practice. This paper complements the literature by showing that the way that international standards are translated and implemented at the national level matters as well. Using a novel historical database on paid maternity leave policies in 160 countries with a time series from 1883 to 2018, I document how informal sector workers in low- and middle-income countries (LMICs) fell by the wayside in the widespread adoption of the International Labour Organization (ILO) maternity protection standards. First, the analysis shows that while the adoption of the ILO Maternity Protection Conventions triggered the introduction and extension of maternity leave policies throughout the world, LMICs ignored the provision of social assistance benefits. Second, even when LMICs extended the coverage of maternity leave policies to the informal sector, the implementation constraints further hindered the access of women workers in the informal sector to maternity benefits.
