The last decades witnessed the emergence of transitional justice as a global norm which obliges postconflict transitioning states to address systematic past human rights violations through purposeful judicial and non-judicial mechanisms. While its typical architecture focused on formal transitions, the dynamics of non-regime transitions and compliance is often neglected in transitional justice literature, and the measures also signify manifold challenges. This article attempted to assess the beleaguered transitional justice measures implemented in Ethiopia's current troubled non-regime transition which came after the authoritarian and Marxist TPLF/EPRDF regime collapsed in 2018 after violent antigovernment protest. Consequently, under the new hybrid elites' leadership, host of justice measures were implemented but they unfolded in the absence of both typical transition and guiding transition roadmap. Through the lens of compliance and resistance in transitional justice, the article finds that rather than addressing legacies of atrocious past, the flawed and instrumentalist implementation of contested justice processes and the mismanagement of the narrow window of opportunity led to unprecedented societal violence and new political complexities. The Ethiopian case, therefore, reveals that seeking the retributive transitional justice measure in the absence of typical regime change and inter-elites bargain, and in an ethnically polarized political transition exacerbate inter-elite discord, bolster ethnic-supported resistance from predecessor elites, and harbor the risk of resurgence of new violence. Hence, it falls short of achieving the compliance with the transitional justice norm such as ensuring accountability (fighting impunity), adequately addressing past wrongs through judicial and non-judicial means and also ensuring non-recurrence of the same in the future.

Usualmente la literatura académica y algunos sectores políticos entienden la justicia transicional como un proceso deseable, en cuanto aspira a dirigir a las sociedades hacia arreglos de organización y convivencia más justos y a la superación de las violencias. Sin embargo, la adopción de modelos alternativos de justicia y la búsqueda de verdades históricas —a veces no compartidas por toda la sociedad— puede hacer emerger viejos y nuevos clivajes ideológicos y grupos de interés para desacreditar estos procesos. Este artículo es un intento por entender cuáles fueron los marcos narrativos utilizados por la prensa y los sectores de la política electoral para legitimar o deslegitimar los mecanismos de justicia transicional en Colombia (2016), Filipinas (2014) y Kenia (2008). Para esto, analizamos 66 piezas de prensa y 24 declaraciones políticas, las que luego clasificamos entre aquellas que apoyan o resisten a la justicia transicional. Encontramos que la prensa puede ser una caja de resonancia para las narrativas adoptadas por los políticos, y que la resistencia a los mecanismos de la justicia transicional puede buscar su desacreditación, pero en otros casos puede orientarse a robustecer los procesos transicionales. Así, la i/legitimidad de los procesos de justicia transicional se deriva tanto de las corrientes ideológicas arraigadas en una sociedad, como de los intereses coyunturales amenazados por la transición.

This state of affairs has often been ascribed to the fact that many of the political actors involved in the civil war have remained part of the political establishment in the post-war phase (Selim, 2018: 52). The article explores the burgeoning Nepalese hip-hop scene – commonly known as nep-hop – as a discursive intervention in the post-war politics of Nepal. Its core argument is that nep-hop oftentimes demonstrates an ethos of peacebuilding through popular culture. Indeed, many songs explicitly criticize violence, war, and the political leaders who recently brought the nation to a civil war. Yet, this political critique appears to often fall on deaf ears, due to the fact that nep-hop is commonly decoded as a radically ‘alien’ and ‘vulgar’ genre by audiences in mainstream Nepalese society. Importantly, however, this should not be read as a rejection of the ideological content of nep-hop, but rather as a negative evaluation of the aesthetic form of the genre, which bars many Nepalese citizens from engaging with its political messages in a meaningful manner.
