Die Evaluationen des Urheberrechts-Wissensgesellschafts-Gesetzes von 2022 zeichnen ein positives Bild von dessen Wirkung für digitale Wissenschaft und Bildung. Die beiden Berichte von BMJ und iRights.Law/BMBF greifen dabei breit und empirisch fundiert die Einschätzungen von Rechtsinhabern und Nutzern auf. Sie gehen auch auf die kontroversen Punkte der Gesetzgebungsgeschichte ein. Der Beitrag stellt die Ergebnisse der beiden Berichte dar und geht ausführlich auf die fortbestehenden Kontroversen um die §§ 60a ff. UrhG ein: Insbesondere sollten unter § 60a UrhG auch Publikumszeitschriften in Unterricht und Lehre vollständig genutzt werden können; eine pauschale Vergütung für Schrankennutzungen unter § 60h UrhG sollte stets an repräsentative Stichproben gekoppelt werden; die TDM-Schranken der §§ 44b, 60d UrhG sollten als rechtspolitisches Instrument zur Begrenzung bzw. Ermöglichung künstlicher Intelligenz verstanden werden.
