In this article, the authors examine the importance of crime prevention in the context of ethno-social relations. The problem of interethnic interaction is extremely important for any multi-ethnic state. Interethnic contacts are not always positive, which is why the problem of interethnic conflicts is one of the most important and relevant areas of research in modern social sciences. Ethnic conflicts objectively lie on the line of differences between ethnic groups, the subjective basis of which is ethnic identity. The theory of crime and the ways of its prevention is investigated on the basis of the program-target approach. Throughout the research, the authors come to the conclusion that in order to overcome the crime, it is vital to target the most vulnerable groups and implements special programs. As a result of the targeting approach, the ethno-social tensions could be overcome and minimize the proliferation of crime.

The article analyzes the practice of applying punishment in the form of restriction of freedom in the light of modern trends in criminal law policy, which seems relevant, given the ten-year experience that has been formed. The scientific novelty of the presented work lies in the author's approach to determining the role of the punishment in the implementation of modern criminal law policy of the state. The purpose of this study is to establish the correlation of expectation and actual implementation of the use of restriction of freedom as a type of punishment. The methodology of the research is based on the theoretical analysis of the main scientific provisions on the essence of punishment in the form of restriction of freedom and the practice of its application, based on the formal legal method. The practical implementation of the legislative model of restriction of freedom in accordance with the general indicators of the number of convicts in Russia is considered. It is established that the absolute indicators of the number of persons sentenced to restriction of freedom, demonstrating a decrease, in this sense are not correlated with the identification of the specific weight of this punishment in the total number of convicts. It is determined that the restriction of freedom, both as the main and as an additional punishment, has a stable weight in the total number of convicts since 2014. It is concluded that the model of the considered punishment is relevant, but its implementation in the suggested form contains a number of problems that requires its solution.

Антикоррупционное законодательство России: ретроспективный анализ формирования механизма правового воздействияАннотация. В статье исследуются методологические и организационно-практические аспекты правового воздействия на коррупцию в период становления и развития отечественной государственности. Новизна темы исследования заключается в постановке проблемы, связанной с раскрытием причин и условий коррупции как социально негативного явления на отдельных этапах государственно-правового развития; определением ключевых направлений правовой политики в сфере противодействия коррупции, детерминируемых социально-экономическими и политическими преобразованиями. В ходе достижения поставленной цели исследования использовались специально-юридические методы познания, содействующие проведению ретроспективного анализа нормативно-правового регулирования юридической ответственности за коррупционные правонарушения. Результатом исследования является раскрытие правовой природы коррупции, ее сущностных свойств и признаков как социально негативного явления; выявление особенностей мер противодействия коррупции в рассматриваемый период российской государственности; установление тенденций нормативно-правового регулирования коррупционных правонарушений; определение специфики механизма правового регулирования юридической ответственности за коррупцию. Высказано мнение об отсутствии в отечественном законодательстве рассматриваемого периода категориально-правовой оценки понятия коррупции, предопределившем признание мер уголовно-правового воздействия в качестве стратегического ресурса противодействия коррупционным правонарушениям. Сформулированы выводы о факторах, инспирирующих законодательную регламентацию составов преступлений коррупционной направленности, и о специфике реализации наказания и иных мер уголовно-правового характера.
