In the case of administrative responsibilities, the damages of individuals due to acts or actions of administration are compensated by means of full remedy actions. Special provisions for determining the mode of payment of the compensation that will be adjudged in full remedy actions, are not provided in Administrative Jurisdiction Procedure Act, and it has been ruled that determining the mode of payment of the compensation to be ensured in Turkish Code of Obligations is within the power of judge. Additionally, in practice, the courts have exercised their authorities for determining the compensation as capital (namely, lump sum), but determination of compensation as revenue (paying partially at certain intervals) have been limited to a few examples. As is the practice, the Council of State has decided that the compensation shall be determined as revenue at certain intervals instead of capital in claims of material compensation arising from maintenance fees/caretaker expenses. The generally accepted practice in the determination of compensation as revenue has made many administrative jurisdiction procedures performed similarly in terms of full remedy actions. In addition, determination of compensation as revenue will make changes in the material aspect of the problem such as the mode of payment of the compensation, charging interest or reduction in the compensation, and also in the practices regarding the proceedings in these trials such as writing the result of the judgment and judging the litigation expenses. Considering that the decisions made have gained stability, it is understood that the case in question will be focused in administrative justice procedures (at least in terms of aforesaid compensation element) in the forthcoming period. Besides, even if it is not within the context of full remedy actions, the measures to be taken in order for the compensation that will be judged, not to lose economic value, which will gain importance in the case that the compensation is determined as revenue, should also be focused.
