O direito como sistema de contigências sociais

Abstract: O artigo propõe uma nova abordagem behaviorista do direito como sistema de contingências sociais, cujo objetivo é punir ou recompensar determinadas condutas, consideradas pelos instituidores de normas jurídicas como sendo, respectivamente, prejudiciais ou benéficas à obtenção de fins socialmente desejáveis. “…For several years now, Aguiar has developed this systematic behavioral interpretation of law, which addresses most of the issues discussed in jurisprudence concerning the characteristics of law (cf.
