The presented article describes organized crime as a phenomenon that encroaches on the safety of road freight transport and leads to the disappearance of drivers. Researchers who have studied organized crime and current issues that arise during the establishment of missing persons have been identified. The signs of modern transnational crime, which uses transport corridors and truck drivers for their own criminal purposes, are formulated. It is argued that such crimes can be divided into two groups: those that encroach on the safety of the driver, vehicles or cargo, and those related to the involvement of the driver in criminal activities. The structure and features inherent in international criminal groups are described, their activity in the aspect of the given problems is characterized. Emphasis is placed on quarantine measures imposed by a number of countries due to the COVID-19 virus pandemic. It is noted that transnational criminal groups mainly use Ukrainian citizens living in border regions and may be involved in the illicit trafficking of weapons and drugs to commit such crimes. It is pointed out the need for increased attention of operational units to work out the leaders of the above groups using a comprehensive approach to the conduct of investigative actions and operational and investigative measures. The basic rights of operational units during the search for missing persons are outlined. It is emphasized that the time factor is extremely important for the search for persons. These shortcomings in the work of the National Police of Ukraine in this direction and to improve the situation on the roads outlined the main gaps in the legislation. Drivers carrying out long-distance and international freight transportation were interviewed in order to better understand the issues and develop adequate measures. The obtained results are based on statistical data and practical examples. Ways to optimize work in this area are proposed. The purpose of the study: to substantiate the current issues of investigative work of the National Police in the context of combating organized crime and to identify ways to optimize activities in this area. The methodological basis of the article is a dialectical approach to the analysis of situations of disappearance caused by the activities of organized criminal groups. Methods of formal logic are used in the work: analysis, synthesis, induction, deduction, analogy, abstraction. As well as statistical, system-structural methods and forecasting method. The scientific novelty of the article is that the authors were among the first in Ukraine to make a scientific description of the problems of search work in the context of combating organized crime in the field of freight transport. There is always a tendency in law that there is no way a society can exist without a crime commission, as a society without crime is like a human being without blood. Even though the crime commission has become a common phenomenon in a given society, its reduction and prevention are very imperative for the interest and well-being of the society. Every society that is regulated by a legitimate setup has the responsibility in ensuring the peace and security of this society by taking relevant measures in reducing the rate of crime committed in that society. The problem we face here remains that even though with all the laudable efforts of the various law enforcement agencies and organs in Ukraine, it is still practically difficult and impossible in preventing crime commissions in the country, and there still exists a continuous increase rate of crimes committed in the country. This constant increase in crime commission has provoked a doubt in the mind of many as the customary objective of the society is that of crime prevention. In answering this critical controversy that has surrounded the state of Ukraine as to problem affecting the prevention of crime, it will be proper for us to examine some of those justifications posed that have made it difficult for the State of Ukraine and other law enforcement officials in combating and preventing crimes in the country. It is therefore this backdrop that we think something needs to be done by the State of Ukraine to use all the appropriate measures in ensuring security and social order in the society.
The purpose of the article is to formulate the author’s vision of the concept of “crime prevention in the customs sphere”. The methodological basis of the article is a set of techniques and methods of scientific knowledge. All methods were used in conjunction and complementarity, which made it possible to achieve this goal. In the process of research, general scientific and special methods of scientific cognition were used, in particular: the philosophical method of materialist dialectics; terminological approach; system structural, comparative legal and logical legal methods.An analysis of the scientific literature shows that scholars have different interpretations of the concept of “crime prevention”, which focuses on the feasibility of understanding this definition in a broad and narrow sense. According to a broad approach to crime prevention in the customs sphere, it is regulated by the current legislation of Ukraine with socially important and useful activities of authorized entities, which is to create a safe social environment and minimize the existing destructive, especially dangerous processes, as well as expressed in systematic prevention, which finds objective coverage in a set of preventive and educational measures, tools and methods aimed at identifying the determinants of crime, their labeling, disposal, as well as building public intolerance to them. According to the narrow understanding of crime prevention in the customs sphere, there is a set of preventive and educational measures, tools and methods used by specially authorized entities to minimize the action and complete “removal” of determinants of crime in the state, as well as building collective social awareness about the special negative nature of such determinants and intolerance to them.It is generalized that crime prevention is aimed at those factors that potentially or actually lead to the manifestation of crime in society as a complex phenomenon or its individual types and kinds. These are, in particular, drug addiction, alcoholism of the population, popularization of the criminal subculture, prostitution, low level of legal awareness of the population and education in general, shortcomings in the work of public authorities and more.
