Paternalism and Sentencing

Abstract: Research consistently shows that, on the whole, women are sentenced more leniently than men. Chief among the theoretical explanations for this phenomenon is the chivalry/paternalism perspective, which asserts that women are treated more leniently than men because they are viewed as weak and in need of protection. We discuss this perspective, its empirical support, as well as alternative theories and future directions for research.
