Pitfalls in Protection: How Theory Can Enrich Our Understanding of Regulatory Compliance Problems in Planning Practice

Abstract: This paper responds to demands for greater academic investigation into environmental protection, specifically the practical and structural problems which underpin regulatory compliance in the planning system. It critiques traditional theories of regulation and answers calls for the development of a thematic lens to facilitate the scrutiny of not only operational practice, but also the broader institutional regime. An empirical investigation builds upon the construct of really responsive regulation to study pla… Show more

“…Many of the epistemic challenges discussed in the literature address the limits of and differences in knowing what it means to be responsive (Baldwin & Black 2008; Lehmann Nielsen & Parker 2009; McKay et al . 2015; Sheehy & Feaver 2015). Such challenges are identified at the level of both individuals (actor‐centered responsiveness) and regulatory systems (institution‐centered responsiveness).…”

“…Most of the ethical challenges discussed in the literature can be summarized as: "To be responsive to one stakeholder is to be potentially unresponsive to another" (Bryer 2007, p. 482)but more is at stake. Many of the epistemic challenges discussed in the literature address the limits of and differences in knowing what it means to be responsive (Baldwin & Black 2008;Lehmann Nielsen & Parker 2009;McKay et al 2015;Sheehy & Feaver 2015). “…Specific planning theories come in many forms, each with their own intellectual underpinnings, peculiarities, contributions and problems (Binder, 2011). Planning theories are important to scholars and practitioners, as the work of planning research and practice is shaped by intuition derived from assimilated theoretical knowledge (Campbell & Fainstein, 1996;McKay, Murray and MacIntyre, 2015). For the purposes of this paper, we consider planning theory to include theoretical content from planning scholarship and associated disciplines that offers utility to planning practice in meeting the challenge of conceptually depicting and practically creating better places.…”
