Abstract: There is an ever-present danger that a private association may evolve into an enterprise with an elitist structure that extensively exploits its powers. While it is well known that the key role in limiting the excessive powers of state elites belongs to civil society, the question of policing the elites of monopolistic private orders is understudied. We use the case of the Fédération Internationale de Football Association's (FIFA) private order to illustrate how private orders evolve under constraints imposed … Show more

“…A key point for Cisneros (2020) is the possibility of sports disputes to be considered in court, which provides for the jurisdiction of disputes involving sports governing bodies (SGBs) to judicial review (judicial review). Through a systematic, thorough, and step-by-step study, the author concludes that athletes and other participants in the field of sports, whose rights and responsibilities are affected by PSO decisions, on this basis should be guaranteed protection of their rights, freedoms, and interests in private, and in public.…”

“…Ville (2007) demonstrates that competition between BAs encourages productive roles instead of redistributive, rent-seeking efforts. Hock and Gomtsian (2018) propose that a lack of competition was a major factor in the development of harmful rent-seeking practices in the case of FIFA. Control by other associations can also emerge through the counter-organization of affected stakeholder groups (Reveley − Ville, 2010;Schneiberg, 1999).…”
