Prosecutorial Politics: The ICC's Influence in Colombian Peace Processes, 2003–2017

Abstract: In August 2016, in Havana, Cuba, the Colombian Government signed a peace agreement with the Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo, FARC-EP, after four years of negotiations. “…A pesar de este complejo y prolongado proceso de interacción y adaptación interinstitucional entre la Fiscalía de la CPI y las autoridades colombianas, ninguna de las cuales controla la narrativa por completo (Urueña, 2017), lo cierto es que la primera conserva su rol de verificación de la admisibilidad de la situación en Colombia. “…22 Among the countries where one had to wait long for transparency regimes to be implemented are Spain, where the 1977 Amnesty Law prevented any attempts to uncover atrocities committed by the Franco regime (Aguilar, 2012), and Colombia, where human rights violations associated with the civil war were not prosecuted and were kept secret long enough to warrant an open letter published in daily newspapers by the Office of the Prosecutor of the ICC (Urueña, 2017). Similarly, in Northern Ireland, skeletons in the closet from the time of the so-called "Troubles" were sealed to remain secret as part of the peace process known as the Good Friday Agreements.…”

“…In contrast, there has been an exclusion of so-called complex victims in this study, which under the lens of the pioneers of victimology are seen as latent victims, those prone to victimization, that is, those who contribute to the offense (Bernath, 2016). In the Colombian case, they are the victims who suffered damages on the occasion of the actual victimization and the asymmetrical circle of victim–victimizer (Garzón, 2018: 156; Urueña, 2017) where (a) the state fought the guerrillas, the peasantry of communist ideology and the civilian population labeled as guerrillas; (b) the guerrillas fought the members of the security forces, the civilian population and the paramilitaries; and, (c) the paramilitaries wiped out the social identities that they disliked, such as drug addicts, common delinquency, prostitutes, homosexuals, guerrilla sponsors and members of the political party of communist ideology Unión Patriótica (Fattah, 2014; Hikal, 2011; Mendelsohn, 1974; Santamaría-Rodríguez, 2017).…”
