Regional Parliaments and the Early Warning System: An Assessment Six Years after the Entry into Force of the Lisbon Treaty

Depuis le traité de Lisbonne, les parlements régionaux peuvent être consultés par les parlements nationaux dans le cadre du Mécanisme d’alerte précoce visant à dénoncer les projets législatifs européens contraires au principe de subsidiarité. Parmi les huit États membres comportant de tels parlements régionaux, six États ont un système législatif bicaméral. Cet article examine la thèse selon laquelle l’une de ces deux chambres, la chambre haute, pourrait être investie de la tâche de porte-parole des intérêts desdits parlements régionaux. Cette thèse est étudiée, d’une part, sous un angle théorique, à la lumière des particularités des chambres hautes, de leurs procédures d’évaluation de droit européen ainsi que de la diversité de mécanismes institutionnels permettant aux régions d’exprimer leurs avis, et, d’autre part, en évaluant la participation des chambres hautes et des parlements régionaux au Mécanisme d’alerte précoce.
