Requirements for Documentation, Data Collection and Scientific Evaluations

Abstract: This chapter describes the process and evaluation behind several of the flexibility elements introduced into the Basic Regulation. Firstly, it describes how a fishery may be granted a "high survival exemption" (HSE) or "de minimis" to the Landing Obligation, for a particular regulated species. It details the process of generating any exemption supporting evidence by Member States and the evaluation process. The impact of the Landing Obligation on the scientific advice for setting fishing opportunities is also … Show more

“…But the Nephrops trawl fisheries' bids for exemption in several areas of the North Sea were judged to need further evidence [89], and the Nephrops trawl fishery in SW Waters was judged to have overestimated survivability, and was granted only a 12-month exemption, after which new data would be required. Rihan et al [90] say that STECF has found it very difficult to provide conclusive advice on some of the exemption claims because of a lack of detailed information.…”

“…Three methodologies for conducting survival experiments were identified: (1) captive observations; (2) vitality/reflex assessments; and (3) tagging/biotelemetry experiments [90]. ICES set up a workshop on methods for estimating discard survival (WKMEDS) in January 2014 to review current estimates of discard mortality; improve understanding of the explanatory variables associated with discard mortality; and establish approaches for measuring and reducing the uncertainty associated with mortality estimates.…”

“…"Quota uplift" provisions, introduced to the CFP to address the TAC implications of the landing obligation are still untested but could be used to adjust the relative stability keys in circumstances where need can be demonstrated (Rihan et al 2019). For example, Article 16(2) could be potentially used to change a relative stability key where an adjustment of fishing opportunities is needed to ensure relative stability of landings after accounting for what fleets can and cannot catch with the national quota.…”

“…15 of EU Reg., 1380. For the high survival exemption to be implemented, fishery-specific evidence must be presented to the European Commission, which will consider the merits of an exemption to the LO on a case-by-case basis (Rihan et al, 2019).…”
