The presence of Law Number 11 of 2022 concerning Crimes Sexual Violence seeks to provide legal umbrella for existing problems, as well as manifestation Child Protection which has not been accommodated, especially in the criminal burden perpetrators of sexual crimes and the stages of efforts to recover victims due to sexual crimes they have experienced. It can be said that TPKS Law is synchronization of Child Protection Law by emphasizing sexual violence against children, through structuring stages of recovery given by children as well as in order to improve judicial process as special treatment needed by children. This research uses normative legal research methods through the approach of applicable laws and regulations and literature studies. The statutory regulation approach originates from primary data in form Law Number 35 of 2014 concerning Child Protection and Law Number 11 of 2022 concerning Sexual Crime Crimes and literature studies. The results this study will show that presence of TPKS Law has had a positive impact and new legal protection efforts for vulnerable people, especially children as victims sexual crimes.

Untuk melindungi dan memperjuangkan hak-hak perempuan dan anak-anak yang menjadi korban kekerasan seksual. Kebijakan ini bertujuan untuk menegakkan hukum dan memberikan sanksi yang tegas terhadap pelaku kekerasan seksual serta memberikan perlindungan dan dukungan bagi korban. Metode pendekatan yang digunakan yuridis sosiologis yaitu sebuah metode penelitian hukum yang digunakan dalam upaya melihat dan menganalisa suatu aturan hukum yang nyata dan ada di dalam masyarakat. Metode pengumpulan data dengan wawancara, penelitian kepustakaan, studi dokumen, dan menggunakan metode analisis data kualitatif. Kebijakan hukum pidana mengenai tindak pidana kekerasan seksual menurut KUHP didalamnya mengatur tentang perzinahan, perkosaan persetubuhan dengan perempuan di bawah umur, pencabulan. Problematiknya berada pada sistem hukum (substansi, struktur, dan budaya hukum) yang belum memihak pada keadilan bagi korban. Maka dapat disimpulkan bahwa Kebijakan hukum pidana mengenai tindak pidana kekerasan seksual menurut Kitab Undang-Undang Hukum Pidana (KUHP) termuat dalam Bab XIV tentang kejahatan terhadap kesusilaan yang didalamnya mengatur tentang perzinahan, perkosaan persetubuhan dengan perempuan di bawah umur, pencabulan

Feminist Legal Theory is a legal theory that was born during the second wave of the feminist movement in America. The main object of study of the Feminist Legal Theory (FLT) is criticism of patriarchal and discriminatory legal products. Legal products in Indonesia are not immune from such problems, even though the constitution has mandated in Article 27 paragraph (1) of the 1945 Constitution which confirms that every citizen has the same position before the law. However, there are several articles or verses that are enigmatic and not in favor of women. The purpose of this study is to analyze law in Indonesia, especially criminal law with the study of Feminist Legal Theory to find out how far criminal law accommodates justice for women. In addition, it can also be seen where the problem of injustice for women is in the formulation of criminal law in Indonesia. This study uses a normative legal research method with the approach used in solving the problem is a statutory approach (statute approach) and conceptual (conceptual approach). The results of this study indicate that although there are problems in the Criminal Code as a positive law in Indonesia, the presence of the TPKS Law is able to provide justice for women in handling and protecting criminal acts of violence against women.
