This article moves beyond a focus on the brute force involved in high-profile land grabs to examine the way legitimation, regulation and coercion intersect in Cambodia's property regime. It builds on the 'powers of exclusion' framework developed by Hall, Hirsch and Li to argue that increased connections within civil society in Cambodia and engagement with Western commodity markets have motivated state and private concessionaires to use different means of land exclusion, with less outright force and a greater focus on repressive regulation and legitimation. These exclusionary powers work through informal political connections, secrecy and obfuscation, which the authors term the 'power of informality'. This argument is substantiated with two case studies that illustrate a move away from the dominant narrative of forceful expulsion of land users in Economic Land Concessions (ELC) towards approaches that provide in-kind compensation and carve out land for smallholders: a recent land titling campaign in ELC areas, and the first oil palm ELC to gain responsible investment certification. While the authors remain cautious of the implications of this shift, given the persistence of the power of informality, these cases illustrate the potential for new forms of state-society relations: a shift from fear of authorities to a demand for greater accountability and responsiveness.We would like to thank the editors of Development and Change and the anonymous reviewers for their helpful comments. Kedaulatan ekonomi menjadi penting oleh setiap lapisan masyarakat dalam mempertahankan kelangsungan hidupnya. Namun demikian, penguatan jaminan kepastian hukum tanah dan keterbatasan akses permodalan, sebagai landasan berusaha mereka, masih menyisakan persoalan. Tulisan ini bertujuan untuk menguraikan solusi atas segenap persoalan pendaftaran tanah dalam memberikan jaminan kepastian hukum tanah dan mempermudah akses permodalan. Metode penelitian yang digunakan dalam kajian ini adalah kualitatif deskriptif yaitu mengadopsi pendekatan tinjauan literatur sistematis yang dipadukan melalui diskusi informal dengan informan kunci serta memanfaatkan pengalaman peneliti. Hasil penelitian menyebutkan beragam permasalahan seperti duplikasi kepemilikan atas keberagaman dasar pembuktian hak atas tanah, perbedaan kondisi sosial ekonomi setiap lapisan masyarakat, masih signifikannya subjek dan objek atas tanah yang belum berkekuatan hukum, perlu segera diupayakan solusinya. Kajian ini menawarkan beberapa rekomendasi solusi yang dapat dipertimbangkan antara lain: dengan forensik kadaster untuk menuju desa lengkap, membangun ekonomi kerakyatan, menyederhanakan alat bukti kepemilikan hak atas tanah dengan perbaikan peraturan perundangan dan pendekatan gotong royong. Pada akhirnya, program sertipikasi tanah dapat menjadi salah satu kunci dalam menentukan keberlanjutan usaha yang dilakukan di atas maupun di bawah tanah agar tercipta keamanan, keadilan dan kesejahteraan sosial.

This article explores the institution of the public notary in Colombia as an important place for legality where we can appreciate different mechanisms through which law is productive of space and space shapes understandings of the legitimacy of law. I study the notary as a material and social space of interactions between persons (parties, lawyers and public officials), non-human actors (seals, signatures, fingerprints) and practices (solemn oaths, making of deeds). I highlight three aspects. First, at the notary the relationship between the private and public orders is enacted. Private actions (birth, marriage or sell of property) once notarized through the stamping of the seal are now public acts. Second, contrary to think of the notary as space empty of law since it does not solve any legal controversies, I argue that particular legal knowledge practices at the notary consolidate processes of individuation and reification essential for the making of both, persons (criticizes) and things (property); these practices are also key in the making of the state’s authority. Finally, I review the relationship between the notary and the instrument (the sealed document) to reveal the importance of certain ideas such as “public faith”. These ideas allow the notary to detach him/herself from the agency of the instrument; however, inherent indeterminacies remain in these configurations that reveal the temporal and variable character of the reality the notary attest to. This is important because when we partake in the formalization regimes happening at these places, we implicitly accept and maintain some of these cognitive constructions that constitute important pillars for both, the market and the state.
