The Paris Agreement embodies a flexible approach to global cooperation, aimed at encouraging ever more ambitious climate action by a variety of players on all levels of governance. Regional organizations play an important role in mobilizing such action. This Element provides novel insights into the conditions under which policy entrepreneurs can bring about transformative policy change in regional settings, with a focus on the European Union (EU) and the Association of Southeast Asian Nations (ASEAN). It finds that opportunity structures in the EU have been conducive to successful climate-progressive policy entrepreneurship at several key junctures, but not consistently. In contrast, the ASEAN governance context provides few access points for non-elite interests, making it fiendishly difficult for policy entrepreneurs to push for substantive policy change in the face of powerful domestic veto players. O presente artigo tem como objetivo debater algumas políticas públicas e projetos de lei para a mineração que estiveram em pauta nos governos de Michel Temer e Jair Bolsonaro, bem como suas consequências. A partir de revisão bibliográfica, dados secundários e análise documental o texto faz, inicialmente, uma breve caracterização da espacialização dos conflitos associados à mineração, em particular envolvendo povos indígenas, e apresenta os Territórios Livres de Mineração como uma outra forma de se pensar o uso dos territórios. Em seguida, uma avaliação institucional descreve a influência corporativa sobre o Estado e seus principais resultados. Então, o artigo sistematiza questões que carecem de uma discussão crítica, incluindo, a mineração em Terras Indígenas, a insegurança dos complexos minerários; a injustiça fiscal e tributária; as fragilidades do licenciamento ambiental; e os retrocessos causados pela reforma trabalhista. Por fim, são organizadas propostas para o aprofundamento do debate sobre esses temas.
