The application of the death penalty for perpetrators of crimes is an absorbing topic to talk about because it reaps the pros and cons. In Indonesia, despite these pros and cons, the death penalty is still maintained, but only imposed on perpetrators of crimes, categorized as extraordinary crimes, one of which is narcotics crimes. The government's reason for implementing the death penalty is none other than because the death penalty is considered to have a deterrent effect, so that it will be able to reduce the number of narcotics crimes in Indonesia. Therefore, there are several things that we need to review, including, how is the regulation of the death penalty for narcotics criminal offenders based on Law Number 35 of 2009, on Narcotics?How is the implementation of the death penalty for narcotics criminal offenders in Indonesia? Has the application of the death penalty for narcotics offenders proven effective in reducing the number of narcotics crimes in Indonesia?It is essential to answer these questions to increase knowledge for readers and contribute in formulating a more effective and efficient strategy in the fight against narcotics crime. The study was conducted through normative legal research, and the data in this study were secondary data, which consisted of the primary law materials and the secondary law materials. The results of this study show us that Indonesia has declared narcotics crimes as a high-risk crime so that elements concerning narcotics crimes and sanctions are specifically regulated in Law No. 35 of 2009 on Narcotics. However, the number of narcotics crimes in Indonesia remains high, even though the death penalty has been repeatedly imposed on the perpetrators of narcotics crimes, which proves that the death penalty is not effective as a preventive action in combatting narcotics crimes in Indonesia.

Disguised Foreign Controlled Companies and the Facilitation of Transnational Criminal Activities in Thailand

The primary objectives of the study are to examine the role of a business using Thai nationals as nominee shareholders in foreign-controlled companies in the facilitation of the transnational criminal groups' activities in the tourist destinations, and their social and economic impacts on the country. Nominee shareholder appointment in a legal entity has commonly been recognized as one of the techniques employed by criminal groups to launder and obscure the ownership of their illegal assets. However, this study points out that this type of company also performs other functions in providing resources and a platform for criminal groups to further their goals. The study used mixed methods by gathering qualitative data through conducting in-depth interviews and focus groups with 55 participants from relevant government agencies and private sectors, and by gathering quantitative data through conducting public surveys consisting of 1,160 participants from six provinces across five different regions in Thailand. The study concluded that there is a strong need for the country to improve monitoring mechanisms through legal changes, and collaborations among public, private and civil society as the practice of nominee shareholder appointment, although perceived as a normal practice in the global field of business, such a practice can invite unintended consequences, which can be a serious cause of concern due to the links with illegal activities operated under the umbrella of transnational organized crime.

Green criminology provides a significant opportunity for interdisciplinary engagement to address the many environmental problems of the twenty-first century that are too complex to be solved through a single disciplinary lens. Hall (2014) has called for increased collaboration between green criminologists and legal scholars while also acknowledging that this form of interdisciplinarity is more challenging than for more traditional forms of criminology. This paper adopts Hall’s call as a starting point for a critical exploration of two areas that offer ground for collaboration: positioning analyses of environmental harm within wider regulatory frameworks and considering the ways human and non-human victims interact with ‘the mechanisms of justice’ to exercise ‘environmental rights’ (Hall 2014: 105). We examine these areas drawing on the case of wildlife trafficking in Vietnam. We argue that ‘multispecies justice’ presents a useful framework to progress green criminology–law collaborations in the Vietnamese and other contexts.
