This study aims to analyze the Government's rejection of the Draft Law on General Election, which has been stipulated in the 2020-2024 National Legislation Program and its relation to the 2024 General Election. This type of research is a normative study using a political-law approach. The technical analysis used in this study, namely hermeneutic analysis, interpretation analysis, and SWOT analysis. The results show that the Government's rejection of the Draft Law on General Elections that have been stipulated in the 2020-2024 National Legislation Program will increase Jokowi's political power as a cadre of the Indonesian Democratic Party of Struggle and will provide electoral benefits to gain constituent votes in the 2024 Election. This is reinforced by a SWOT analysis related to implementing the presidential threshold in the 2024 General Election, where only the Indonesian Democratic Party of Struggle can directly carry its cadres to become Presidential and Vice-Presidential Candidate Pairs without a coalition of political parties. Meanwhile, eight political parties must form a candidate for the Joint Candidate Pair of Political Parties in the 2024 Election. Furthermore, it is hoped that President Joko Widodo will continue to carry out his role as head of state and not abuse power at the time of appointing a task force, both at the provincial and Regency/City levels. In addition, it is hoped that every political party will continue to carry out the best strategy in promoting Presidential and Vice-Presidential Candidates without having to lead public opinion regarding the presidential threshold issue in the 2024 General Election. Abstrak Penelitian ini bertujuan untuk menganalisis penolakan Pemerintah terhadap Rancangan Undang-Undang tentang Penyelenggaraan Pemilihan Umum yang telah ditetapkan dalam Program Legislasi Nasional Rancangan (Prolegnas) 2020-2024, serta keterkaitannya pada Pemilihan Umum 2024. Jenis penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan politik hukum. Adapun teknis analisis yang digunakan dalam penelitian ini, yaitu analisis hermeneutik, analisis interpretasi, dan analisis SWOT. Hasil penelitian menunjukkan bahwa penolakan Pemerintah terhadap Rancangan Undang-Undang tentang Pemilihan Umum yang telah ditetapkan dalam Prolegnas Rancangan 2020-2024 akan memperbesar kekuasaan politik Jokowi selaku kader Partai PDIP-P, dan akan memberikan manfaat elektoral untuk meraih suara konstituen pada Pemilu 2024. Hal ini diperkuat dengan analisis SWOT terkait implementasi presidential threshold pada Pemilu Tahun 2024, dimana hanya PDIP yang dapat langsung mengusung Kadernya menjadi Pasangan Calon Presiden dan Wakil Presiden tanpa koalisi atau gabungan partai Politik. Sedangkan delapan Partai Politik di antaranya harus membentuk usungan Pasangan Calon Gabungan Partai Politik pada Pemilu Tahun 2024. Selanjutnya, diharapkan Presiden Joko Widodo tetap menjalankan peranannya sebagai kepala Negara dan tidak menyalahgunakan kekuasaan pada saat melakukan PLT, baik di tingkatan Provinsi maupun Kabupaten/Kota. Selain itu, diharapkan setiap Partai Politik tetap melakukan strategi terbaik dalam mengusung Calon Presiden dan Wakil Presiden tanpa harus menggiring opini publik terkait permasalahan presidential threshold pada Pemilu Tahun 2024.
Penelitian ini bertujuan untuk menganalisis efektivitas pengamanan Intelijen Kepolisian terhadap putusan pengadilan atas objek sengketa di Provinsi Sulawesi Selatan. Penelitian ini menggunakan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis, karena melihat penerapan hukum sebagai suatu kondisi faktual di lingkungan sosial dan hubungannya terhadap norma hukum. Penelitian ini dilakukan di Provinsi Sulawesi Selatan, dengan jumlah responden sebanyak 92 orang. Analisis data dalam penelitian ini menggunakan pendekatan kualitatif, dimana mengolah output dari kuesioner, dan disajikan dalam bentuk tabulasi frekuensi (F) dan distribusi persentasi (%). Hasil penelitian menunjukan bahwa pengamanan Ditintelkam Polda Sulawesi Selatan terhadap proses eksekusi atas objek sengketa di Provinsi Sulawesi Selatan berdasarkan Perkap BIN No. 2 Tahun 2013, dapat dinilai dari lima aspek, antara lain: Sasaran Pengamanan; Pelaksanaan Pengamanan; Koordinasi dan Administrasi; serta Pengawasan dan Pengendalian. Perolehan data dari keseluruhan indikator berdasarkan aspek-aspek pengamanan Ditintelkam Polda Sulawesi Selatan menunjukkan hasil yang kurang efektif. Dibutuhkan keseriusan dalam meningkatkan efektivitas pengamanan Ditintelkam Polda Sulawesi Selatan guna memastikan proses eksekusi putusan pengadilan atas objek sengketa bisa lebih efektif di masa akan datang.
This study aims to describe the simultaneous Village Head election disputes in 2016 and 2018 in North Luwu Regency. This research combines normative juridical and empirical research methods. The primary data were collected using direct interviews, while the secondary data was collected using literature study techniques. The data obtained in this research were then analyzed qualitatively to describe problems and answer study purposes. The results show the implementation of the simultaneous Village Head election of 2016 and 2018 in North Luwu Regency, consisting of 64 Villages. Of the 64 simultaneous Village Head elections, six of them are still considered to contain legal defects by several candidates. Accordingly, the six candidates submitted lawsuits against the simultaneous Village Head election results at the State Administrative Court to prove the violation. In this case, there are two lawsuits for Regent Decision No. 188.4.45/386/VI/2016 and four for Regent Decision No. 188.4.45/479/XI/2018. One of the six lawsuits was granted by the Judge in the Decision of the State Administrative Court, but the Decision of the State Administrative High Court voided the Court Decision of the first instance. In contrast, the other five lawsuits were immediately dismissed by the Judge at the Decision of the State Administrative Court. Therefore, it is recommended that the Regency Government be able to predict and provide solutions to a series of problems that will arise at all stages of implementing the simultaneous Village Head election. In this case, to minimize future disputes of the simultaneous Village Head election.
This study aims to understand custom as a key concept and siri’ as the core concept of Ugi-Mangkasara Culture based on a legal anthropological perspective. This study uses a normative approach that focuses on tracing the history of customary law related to the object of the problem. The object of study in this research is documents and manuscripts about Ugi-Mangkasara culture. The analysis used is a qualitative analysis based on the perspective of legal anthropology, so that the object of study can be interpreted and described in a narrative form. The study results show that custom as a key concept and siri’ as the core concept of Ugi-Mangkasara culture is a product of the culture of the Ugi-Mangkasara human child, which is full of values from various dimensions as the identity of the Ugi-Mangkasara human child. For Ugi-Mangkasara human children, respecting customs is a social obligation of the culture owner. Enforcing siri’ is respect for self-respect and human dignity. The values contained in the Ugi-Mangkasara culture can be used as a spirit for human children who own the culture in particular and in general for Indonesian children as part of the Ugi-Mangkasara tribe.
This study aims to find out what laws and regulations in Indonesia protect children as criminals due to being stimulated by pornography. This research uses normative legal research methods. The data used in this study are primary data and secondary data. The data analysis technique used is qualitative data analysis techniques. The study results indicate that several laws in Indonesia protect children as perpetrators of criminal act due to being stimulated by pornography. In this case, it consists of Law No. 4 of 1979, Law No. 39 of 1999, Law No. 17 of 2016, Law No. 44 of 2008, and Law No. 11 of 2012. This can be seen from all the considerations of the Panel of Juvenile Judges in deciding the criminal case of sexual intercourse committed by the perpetrator YY against the victim of FH. Therefore, it is hoped that law enforcers regarding the handling of children who commit criminal acts resulting from being stimulated by pornography can distinguish their treatment from criminal acts in general, such as theft. In addition, children who commit crimes due to being stimulated by pornography must also be accompanied by a psychologist to ensure that the child's mental condition can return to normal. Assistance by religious leaders must also be done so that children can return to the right path and be blessed by God.
