Penelitian ini mempunyau pokok masalah yaitu bagaimana Peran Organisasi Kemasyarakatan antara Syarikat Islam (SI) dan Front Pembela Islam (FPI) dalam perkembangan hukum Islam Indonesia. Dari pokok masalah itu kemudian di urai menjadi 3 sub masalah, yaitu: 1) Bagaimana Sejarah Perkembangan SI dan FPI di Indonesia ?, 2) Bagaimana Bentuk Pemikiran Hukum Islam SI dan FPI ?, 3) Bagaimana kontribusi Serikat Islam dan FPI Terhadap Perkembangan Hukum Islam di Indonesia?Penelitian ini menggunakan jenis kepustakaan (library research) yang bersifat deskriktif analitik dan komparasi. Adapun pengumpulan data pada penelitian ini yaitu menggunakan teknik kepustakaan,. Metode pengumpulan data yang digunakan adalah teknik kepustakaan dan teknik kutipan. Selanjutnya analisis data menggunakan metode kualitatif yang di inerpretasi dengan menggunakan tekhnik berfikir Induktif (pengolahan data dari umum ke khusus), dan juga tekhnik berfifkir Deduktif (pengolahan data dari khusus ke umum), serta tekhnik berfikir Komperatif (membandingkan pemikiran atau pendapat para pakar satu dengan yang lain). Hasil penelitian ini menjelaskan bahwa kedua organisasi ini yaitu antara SI dan FPI, walaupun kedua organisasi masing masing berlandaskan pada akar yang sama yaitu Islam namun dalam interpretasinya terhadap Islam mempunyai bentuk berbeda, baik dari segi pemikiran maupun dari segi perilaku, dan juga kedua organisasi ini tentu mempunyai peran dalam perkembangan hukum Islam di Indonesia itu bisa kita lihat dari kontribusi kedua organisasi tersebut dalm menyikapi permasalah-permasalahan keagamaan yang sedang terjadi di Indonesia
The aim of this investigation is to comprehend all forms of internet-based dealings within the framework of Islamic Jurisprudence. This exploration is a qualitative and descriptive inquiry conducted through a literature review, utilizing written sources such as scholarly journals, reference books, literature, encyclopedias, scientific articles, scientific papers, and other pertinent sources related to the research subject. The research object is text or writing that elucidates various types of online transactions that are presently prevalent in the current technological age, particularly in Indonesia. The outcome of this analysis suggests that Islam authorizes online transactions provided they adhere to predetermined requirements and do not breach Islamic law. Currently, technologi advancements enable transactions to be conducted effortlessly and expeditiously online, as long as there is a network or internet connection available, which is the principal prerequisite for auxiliary devices in online transactions.In the contemporary digital age, modern technology such as computers or mobile phones can be employed as a medium for processing online transactions. Numerous transactions are carried out through cyberspace (online or via the internet), allowing the involved parties to transact without any restrictions of space and time, whether conducted by individuals or corporations or companies that involve more than one person. In general, a transaction can be interpreted as an agreement made by two or more individuals to accomplish something within a specific duration of time, with several other conditions agreed upon by both parties. Therefore, online transactions in the perspective of Islamic law can be regarded as transactions that have specific provisions that must be agreed upon by the parties involved in the transactionAbstrakTujuan dari penelitian ini adalah untuk memahami segala jenis transaksi online dalam konteks hukum Islam. Penelitian ini merupakan studi deskriptif kualitatif yang dilakukan melalui kajian literatur, dengan menggunakan sumber-sumber tertulis seperti jurnal ilmiah, buku referensi, literatur, ensiklopedi, artikel ilmiah, karya ilmiah, dan sumber lain yang relevan terkait dengan objek penelitian. Objek penelitian ini adalah teks atau tulisan yang menjelaskan berbagai macam transaksi online yang sedang populer di era teknologi saat ini, terutama di Indonesia. Hasil dari penelitian ini menunjukkan bahwa Islam mengizinkan transaksi online selama memenuhi persyaratan yang telah ditetapkan dan tidak melanggar hukum Islam. Saat ini, kemajuan teknologi memungkinkan transaksi dilakukan secara online dengan mudah dan cepat, selama tersedia jaringan atau koneksi internet yang menjadi syarat utama alat bantu dalam transaksi online.Era digital saat ini, teknologi modern seperti komputer atau telepon genggam dapat dimanfaatkan sebagai alat bantu dalam proses transaksi online. Ada banyak transaksi yang dilakukan melalui dunia maya (online atau via internet), sehingga pihak yang melakukan transaksi tidak terbatas oleh ruang dan waktu, baik itu dilakukan oleh individu maupun oleh korporasi atau perusahaan yang melibatkan lebih dari satu orang. Secara umum, transaksi dapat diartikan sebagai sebuah kesepakatan yang dilakukan oleh dua orang atau lebih untuk menyelesaikan suatu hal dalam jangka waktu tertentu dengan beberapa syarat lain yang disepakati oleh kedua belah pihak. Oleh karena itu, transaksi online dalam perspektif hukum Islam dapat dianggap sebagai transaksi yang memiliki ketentuan khusus yang harus disepakati oleh pihak-pihak yang terlibat dalam transaksi tersebut.
Islamic law, as inherent in legalizing a problem faced by society, is an interesting discussion in the reflection of religious law in society. How not, the problems faced by the community continue to grow and are always global, as a large current that must find a solution. The dialogue between the sociological aspect and the establishment of Islamic law is a discourse that continues to get attention and must get factual answers as a result of reformulation of Islamic law towards a better direction. This study is a conceptual study or literature review, which examines data from Islamic law books, books and journals that have relevance. The result of the research shows that, the constructive relation of Islamic law between the sociological aspect and its stipulation is something that cannot be separated. The determination of Islamic law, always considering the sociological aspects of society, shows that the law is for human beings, so it is not surprising that Islamic law is flexible and measurable. The implication that is born in the sociological aspect is the establishment of a sweet and elastic Islamic law determination while still paying attention to its normative and historical aspects.
Kantor Urusan Agama (KUA) in its portion in the regions has a role in forming a happy family. Through several formulated efforts, the realization of their duties and responsibilities is able to have a good influence on prospective couples who are about to get married. One of the efforts made is to run a pre-marital course by educating potential partners about household matters and the turmoil that will adorn their journey. This program aims for prospective brides in order to provide preparation and readiness of body and soul to step on the level of religious perfection. The maqasid sharia is present as a controller as well as the legal basis that guides humans to create a household with the title sakinah mawaddah warahmah. This study was conducted using a juridical-normative approach and a sociological approach which was presented qualitatively. Primary data sources are from 10 KUA as research locations in Bone Regency which were selected and considered capable of explaining the whole area. The secondary data were obtained from various sources, namely books, journals, and other relevant research. The data collection stage was carried out through observation, interviews, and documentation. While the data analysis stage is presented by presenting data, reducing data, and drawing conclusions.
