The adjudication of family disputes by different courts with different jurisdictions in the present court system is ineffective in providing a comprehensive approach to the management of family-related disputes. Furthermore, the adversarial system of litigation of the present courts in Malaysia negates the possibility of resolving conflicts amicably. The establishment of a family court in Malaysia would be in line with the objective of the National Family Policy which encourages the sustainability of the family institution. Basically, this paper seeks to discuss the concept of family court and the need for its establishment in Malaysia. The paper will also briefly discuss the implementation of family court systems in Australia, Singapore and Egypt as these countries have a well developed family court system. The purpose is to learn from their experiences in providing a comprehensive solution to resolve family related disputes in Malaysia.
Higher education institutions (HEIs) largely aim to produce holistic graduates, best in both worlds of academic and non-academic aspects. Although numerous literature has identified and described “holistic education”, it remains an issue if the students actually understand and appreciate the said term. Accordingly, this study seeks to investigate the students’ perception of HEI’s role in producing holistic graduates. Therefore, this paper seeks to answer two research questions, firstly, what are the characteristics of holistic graduates? And secondly, how do students perceive the academic and non-academic programs at the HEIs towards producing holistic graduates? Engaging in mixed approaches of quantitative and qualitative, this study investigates the students’ perception of HEI’s role in producing holistic graduates. An online survey was administered on 357 students of a targeted HEI. The findings reveal that the majority of the students are satisfied with the academic and non-academic programs offered at the HEI, as well as their perceived concept of the “holistic graduate” itself. Hopefully, the paper would shed light on further research in the area of students’ education and higher learning education generally.
The teaching and learning landscape in higher learning institutions are changing from teachercentered to student-centered learning. However, the students' lack of engagement in classrooms is found to become one of the drawbacks in the implementation of studentcentered learning. Aiming to address the problem of students' lack of engagement, this research is carried out to investigate the impact of two teaching strategies i.e. 'think-pairshare' and 'wait time' on the teaching and learning of undergraduates. The methodology employed in the study is qualitative, engaging in action research design and divided into three stages of study, (i) problem identification (ii) action implementation, and (iii) evaluation. Two cycles of investigation were carried out, involving the implementation of "think-pair-share" in the first cycle, and in the second cycle, "think-pair-share" and "wait-time". The data sources for the evaluation were three-folds, (i) lecturer's observation (ii) reflection by the students and lecturer, and (iii) activity sheets by the students. The data are loaded into the computerassisted qualitative data analysis software of ATLAS.ti version 8 for the purpose of analysis and generating the reports of the analysis. The study revealed that both teaching strategies of "think-pair-share" and "wait-time" have tremendously improved the student engagement in the classes. Additionally, the students' learning experience have enhanced with the implementation of these two teaching strategies. And finally, the lecturer's teaching ability also improved. Hopefully, the findings of the study would contribute to the literature on the subject of student engagement and teaching and learning strategies particularly, and other subjects of the higher education level generally.
Generally, Rent to Own (RTO) is a financial scheme offered by financial institutions to help those who cannot afford the 10% initial deposit and access to financial schemes. One value-based intermediation (VBI) initiative is the RTO Islamic financing product. The market segment of this product is for the new generation whereby they can own a house without paying any deposit on account of the fact that housing estates are increasingly expensive. This paper starts with the background concept of VBI, then it discusses on the modus operandi of RTO offered by financial institutions. This paper also discusses legal and Shariah aspects related to RTO. Adopting a qualitative method, the data were collected through semi-structured interviews with relevant parties involved with the RTO product. In addition, some preliminary information had been accessed through the financial institution’s website. This paper found that RTO has played important roles as one viable VBI initiative and it is approved as a Shariah compliant product
In 1990, the creation of underground land is created in the National Land Code. The scarcity of land especially in urban areas has pushed the traditional horizontal land development into vertical land development. Apart from transportation purposes, it is suitable for recreational, storage, and service utility purposes. Within this development, it attracts questions such as how to reconcile the right of surface and underground landowners as the law has allowed the ownership of underground land to be independent and separate from the surface owner. In governing the relationship between the surface and the underground landowners, the provision of access, support, and protection are regulated under the express condition in the document of title. This paper explores the concept of the right of support in Malaysia and the requirement for its application. This paper uses the doctrinal method where statutory provisions, cases, legal articles are examined. In discussing this topic, the practice in Singapore and Australia is compared, and it is suggested in regulating the relationship between surface and underground landowners, the creation of easement to be adopted with the compensation to be awarded to the burdened land.
