In the kinship system in the Arab era, ignorance of their wives was nothing more like merchandise, which could also be inherited. When their husbands die, these wives will belong to the sons who are left behind and some will also marry them and marry them to whomever they like. These incidents leave women to a very low and despicable level. Thus the ignorance community is committed to harassing women, humiliating and depriving them of their rights in a very long historical period. The era of ignorance is like a dark spot in women's civilization. Islam is present as a religion of renewal that is blessed by God Almighty through the intermediary of the Prophet Muhammad SAW, who is present as a bearer of guidance to the truth from Allah SWT, which is preached by His Messenger, as a result of the deviations that have been committed by his followers. Therefore, Islam is a religion that is true and blessed by Allah SWT until the end of time. Then the presence of Islam provides space for justice for women and elevates their position and gives equal roles to men, both for their rights, dignity and their involvement with men in various fields, except in fields that are not in accordance with their nature and nature. as a woman.
Tulisan ini merupakan hasil penelitian terhadap sejumlah karya yang berbicara tentang pentingnya mengatahui sebab dan akibat dari trend nikah muda. Dalam melacak sebab dan akibat pada tulisan ini memanfaatkan studi kepustakaan sebagai pisau bedah kajian yang data-data primernya diolah secara kualitatif dengan. Tulisan ini menemukan, pertama, berat ringannya tanggung jawab yang dipikul bukan hanya ditentukan oleh banyak sedikitnya beban, melainkan tujuan dan pandangan masyarakat terhadap pernikahan dini. Kedua, keputusan menikah di usia muda karena rasa cinta yang begitu besar, kehamilan pra nikah, desakan dari orang tua, mengikuti tradisi daerah sehingga menyebabkan keputusan diambil didasarkan pada suasana batin. Ketiga, akan menerima banyak konsekuensi negatif dari pernikahanya. Dasar agama dalam hal ini ahli fiqih juga berbeda pendapat dalam hal syarat baligh. Menurut Imam Maliki dan Syafii, mensyaratkan harus baligh bagi laki-laki dan perempuan dalam melaksanakan perkawinan, sedangkan menurut Imam Hanafi tidak ada syarat baligh dalam perkawinan, karena adanya hak ijbar. Sedangkan undang-undang perkawinan di Indonesia mensyaratkan batas minimum usia pernikahan adalah 19 tahun untuk laki-laki dan 19 tahun untuk perempuan.
The purpose of this paper is to know concept of engagement in Islam and Christianity, then find the similarities by using literature study, because the materials and data in its preparation use holy book, books, and related literacy, then the data used in this paper is a qualitative and the method used is descriptive. Begins with the understanding of the engagement of the two religions, the author concludes a similarity that can be drawn, namely the engagement is an attempt by the two brides the choose, know, and understand each other before stepping up the dream of marriage. Of the objectives also include the definition of engagement which is choosing, knowing and understanding each other to carry out and make heart choices to create a harmonious family. Regarding the cancellation of the engagement there are similarities in which there is room to be canceled with various established reasons
The purpose of this study is to reformulate efforts to renew the concept of kafa'ah in marriage which often occurs in differences among scholars. While library research is the type in this research that is studied qualitatively by compiling data systematically and is carried out through descriptive-analytic nature with a framework of thinking using deductive methods. Furthermore, this study states that the scholars have different opinions regarding the division of qualification criteria for kafa'ah in choosing a partner, but the majority of scholars argue that there is only one important and non-negotiable factor in the application of the concept of kafa'ah, namely the religious factor. Then, the renewal of the kafa'ah concept can be simplified in the division of kafa'ah qualifications into only two qualifications, namely; First, the religious factor as an important and core factor in determining the selection of a prospective partner and second, determining qualifications is returned to the two prospective brides who want to get married. This simplification aims to increase the progressiveness between the two prospective married couples and also to foster a sense of responsibility for what has been chosen in determining their partner, so that it is hoped that the desired goal of marriage will be realized, namely building a sakinah (peaceful), mawaddah (full love), wa rahmah (love).
