Isbat nikah sangat dibutuhkan oleh masyarakat olehnya itu hakim Pengadilan Agama melakukan “ijtihad” dari ketentuan hukum yang berlaku, kemudian mengabulkan permohonan isbat nikah berdasarkan ketentuan Pasal 7 Ayat (3) huruf (e) Kompilasi Hukum Islam (KHI), yaitu apabila perkawinan yang dimohonkan untuk diisbatkan itu tidak ada halangan perkawinan sebagaimana diatur dalam Undang-Undang Perkawinan, maka Pengadilan Agama akan mengabulkan permohonan isbat nikah meskipun perkawinan tersebut dilaksanakan pasca berlakunya Undang-undang Perkawinan (UUP). Penelitian ini bertujuan untuk mengetahui legalitas dari pencatatan perkawinan melalui isbat nikah. Penelitian ini menggunakan jenis penelitian normatif. Hasil penelitian menunjukkan bahwa legalitas dari pencatatan perkawinan melalui penetapan isbat menurut sebagian ahli hukum berpendapat bahwa KHI tidak termasuk kedalam hierarki Peraturan perundang-undangan yang disebutkan dalam Pasal 7 Ayat (1) Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan. Oleh karena itu, penetapan isbat nikah oleh Pengadilan Agama tersebut tidak lebih hanya sebagai kebijakan untuk mengisi kekosongan hukum yang mengatur tentang itsbat nikah terhadap perkawinan yang dilaksanakan setelah berlakunya UUP.
Introduction: Marriage registration serves to create order in the administration of marriage in society as well as to ensure the upholding of the rights and obligations of husband and wife. This is a preventive state law policy to coordinate the community for the realization of order and order in the system of life, including in marital problems which are believed to be inseparable from various irregularities and disputes between husband and wife. Therefore, the involvement of the authorities/state in regulating marriage in the form of registration is a must.Purposes of the Research: The purpose of this study is to examine and analyze the formulation of legal substance regulation of marriage registration in Indonesia and to analyze and formulate the ideal concept of reformulation of marriage registration law in Indonesia.Methods of the Research: This research is a type of qualitative study that starts from the constructivism paradigm. The approach method used in this study is the socio-legal approach method (socio legal study). A study that examines law as a social fact that can be seen in the realm of experience as a pattern of behavior in the form of social institutions.Results of the Research: The reformulation concept offered by the author is to revise the sound of Article 2 paragraphs 1 and 2 which requires registration of marriages and contains criminal sanctions in it with the aim of providing a deterrent effect for perpetrators of underhand marriages. in the sense that this criminal sanction is used if the previous related sanctions are no longer powerless in the sense that this criminal sanction is a criminal sanction that is used after civil or administrative sanctions are applied.
The future of the Indonesian nation is very dependent on the condition of today's children. Therefore, future attention to children is the main focus, especially for Correctional Students (ADP) who live in the Special Child Development Institution (LPKA). One of the things that is of concern to children who are behind bars is the right to obtain formal and informal education. The purpose of this study was to analyze and evaluate the implementation of the fulfillment of the right to education for correctional students and to design an ideal model of fulfilling the right to education for children in Class II LPKA Gorontalo. The type of research used in this research is empirical normative legal research. The research results show that the educational process for ADP at LPKA is carried out in accordance with the mandate of Law Number 22 of 2022 concerning Corrections where ADP can pursue formal or informal education. In the implementation of formal learning process activities, there are still obstacles in the form of learning processes carried out outside LPKA, so it is necessary to formulate a learning model that should be made like a child-friendly school within LPKA and supported by educators who are truly competent and experienced in educating children.
Implementation of Guidance on Corruption Convicts is one of the things that must receive attention in prisons because it is one of the Extra Ordinary Crimes. In addition, most corruption crimes are committed by people who have a high social status, both in terms of their position before staying in prison as well as in terms of education and economic levels. Arrangements regarding the implementation of guidance for corruption convicts in Indonesia are regulated in the provisions of Law Number 12 of 1995 concerning Corrections and are described through Government Regulation Number 31 of 1999 concerning Guidance and Guidance of Correctional Citizens. Regarding the guidance for corruption convicts, it still refers to the provisions of Government Regulation Number 31 of 1999 where there is no difference in terms of the implementation of coaching which is still carried out through three stages, namely the initial stage, the advanced stage and the final stage. To be able to obtain the right to parole, there are special provisions that are applied to Corruption Convicts, namely in addition to having to behave well while in prison, they must also fulfill the obligation to complete the payment of fines or replacement money to be able to submit a parole proposal.
