W pracy przedstawiono zagadnienie charakteru i roli uchwał Naczelnego Sądu Admini-stracyjnego, zwłaszcza na etapie stosowania prawa. Zaprezentowano pozycję i uprawnienia NSA do podejmowania uchwał mających na celu wyjaśnienie przepisów prawnych, których stosowanie spowodowało rozbieżności w orzecznictwie sądów administracyjnych. Podjęto przy tym rozważania na temat ich prawotwórczej roli.
W pracy przedstawiono podstawy prawne wygaszania mandatu radnego, pochodzącego z wyborów powszechnych, w sytuacji stwierdzenia prowadzenia przez niego działalności gospodarczej na mieniu czy też z wykorzystaniem mienia gminy, w której uzyskał mandat. Zaprezentowano stanowiska sądów administracyjnych wyrażone w tym przedmiocie wskutek skarg na uchwały lub rozstrzygnięcia nadzorcze, mocą których wygaszono mandat radnego z uwagi na przesłankę prowadzenia działalności gospodarczej.
Opus iustitiae PAX – the properly shaped dimension of justice is a guarantee of peaceful – not based on a conflict and violence – relations between citizens and the state. These words fully reflect the leading thought of this study. It is the concern for a good law and a state governed by the rule of law, which lies at the foundation of actions taken within the scope of legal means by the Prosecutor’s Office that – as the “custodian of law” – is entitled to in the sphere of control over administration. Administrative courts execute justice as a separate part of judicial power. Justice and law are conditions for an effective state, good governance and social peace, which have accompanied us for centuries. Administrative courts uphold the principle of equality before the law, which is regulated by Art. 21, par. 1 of the Constitution of the Republic of Poland. Since it is administrative courts which – by performing tasks of control over the activity of public administration – become the guarantee of realization of the above-mentioned principle, their position and range of cognition in the situation of launching administrative-court proceedings by the Prosecutor were presented in the work.
The gloss concerns the Act of the Supreme Administrative Court of Poland of 22 February 2021, case no. I OPS 1/20, stating that “the compensation mentioned in Article 36(1) of the Act of 12 March 1958 on the rules and mode of expropriation of real estate (Dz. U. of 1974 No.10, pos. 64 as amended) from 1 January 1998 may be determined on the basis of Article 129(5)(3) of the Act of 21 August 1997 on real estate economy (Dz. U. of 2020, pos. 65 as amended) for the heir of the property listed in Article 35(1) of the Act of 12 March 1958 on the rules and mode of expropriation of real estate.” Moreover, it states that “the compensation mentioned in Article 36(1) of the Act of 12 March 1958 on the rules and mode of expropriation of real estate must not be determined on the basis of Article 129(5)(3) of the Act of 21 August 1997 on real estate economy (Dz. U. of 2020, pos. 65 as amended) in favour of the real estate purchaser by an agreement concluded after the day of the temporary occupation of this real estate in the mode identified in Article 35(1) of 12 March 1958 on the rules and mode of expropriation of real estate.”
