The registration of land rights in the Land Office has a time limit. This paper discusses about why the community of Tegal Regency has not yet had legal awareness to the registration of land rights transfer, how the legal effect on the delay of registration of land rights transfer based on the purchasing deed of the Making Land Deed Official by the receiving party rights, and how to solve public legal awareness and solutions to land registration delays. The method used in this research is by the Socio-Legal approach that is an approach which is done or used to be a reference in highlighting the problems of applicable legal aspects. the community of Tegal Regency, especially the weak economic community have not yet had legal awareness to register the transfer of land rights based on purchasing deed of the Making Land Deed Official to Tegal Regency Land Office. Suggestion from this research is The existence of strict enforcement of sanctions to unscrupulous officials of the Land Office who make irregularities, all stakeholders make a memorandum of understanding together in the context of registration of the transfer of land rights, revision of article 40 paragraph (1) Government Regulation Number 24 the Year 1997.Keywords: Land Rights Transfer, delay, Community Legal Awareness
The Tegal Regency Government under the leadership of Mrs. Umi Azizah created a program to be able to help overcome unemployment, especially among youth in Tegal Regency, by issuing a policy in the form of Regent Regulation Number 6 of 2019 concerning Facilitation of Entrepreneurship Growth and Development for Youth in Tegal Regency. This research is normative juridical research on issues relating to laws and other accompanying regulations regarding youth and entrepreneurship, this study aims to determine the implementation of the Tegal regent's regulation number 6 of 2019 concerning the facilitation of the growth and development of entrepreneurship. in this study using qualitative data analysis methods, namely normative juridical presented descriptively. Regent Regulation number 6 of 2019 made the main strategy, namely the commitment of Tegal Regency to improve the ranking of all indicators in youth and entrepreneurial policies in a better direction, structural improvements for all indicators, increasing independent entrepreneurs who can contribute to the community and the Tegal Regency Regional Government.Keywords: Implementation, Entrepreneurship, Economy of Tegal Regency.
The implementation of construction development in land acquisition is carried out after the stages of land acquisition, namely: the planning stage, the preparation stage, the implementation stage and the stage of handing over the results of land acquisition. However, in reality there is construction implementation prior to the four stages of land acquisition. An example is the construction of the Tefmo Dam in South Central Timor Regency and the construction of the Tefmo Dam in Kupang Regency, East Nusa Tenggara Province. The problem examined in this study is how the implementation stages of construction development in land acquisition for public purposes and what are the legal consequences for the implementation of construction development that precedes the stages of land acquisition. The method used in this research is normative juridical. The results of this study provide an answer that the implementation of construction development in land acquisition is carried out after the stages of land acquisition. This is carried out as a form of legal protection for the community regarding their land rights. Then, the legal consequence of the construction that was carried out prior to the land acquisition stage was that the National Land Agency could not carry out an inventory and identification and the Land Assessment Team could not carry out an assessment of land objects because the land objects had been evicted and flattened, so that compensation could not be carried out. Therefore, the National Land Agency and related agencies need to coordinate to make a work map, there needs to be law enforcement and the government must find a solution with all its efforts so that the community receives compensation.Keywords: Construction Development; Land Acquisition; Legal Consequences AbstrakPelaksanaan pembangunan kontruksi dalam pengadaan tanah dilaksanakan setelah tahapan-tahapan pengadaan tanah, yaitu: tahapan perencanaan, tahapan persiapan, tahapan pelaksanaan dan tahapan penyerahan hasil pengadaan tanah. Akan tetapi dalam kenyataannya terdapat pelaksanaan pembangunan kontruksi mendahului keempat tahapan pengadaan tanah. Sebagai contoh adalah pembangunan Bendungan Temef di Kabupaten Timor Tengah Selatan dan Pembangunan Bendungan Tefmo di Kabupaten Kupang Provinsi Nusa Tenggara Timur. Masalah yang diteliti dalam penelitian ini adalah bagaimana tahapan pelaksanaan pembangunan kontruksi dalam pengadaan tanah untuk kepentingan umum dan bagaimana akibat hukum terhadap pelaksanaan pembangunan kontruksi yang mendahului tahapan pengadaan tanah. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian ini memberikan jawaban bahwa Pelaksanaan pembangunan kontruksi dalam pengadaan tanah dilaksanakan setelah tahapan-tahapan pengadaan tanah. Hal ini dilaksanakan sebagai bentuk perlindungan hukum kepada masyarakat akan hak atas tanahnya. Kemudian, akibat hukum dari Pembangunan kontruksi yang dilaksanakan mendahului tahapan pengadaan tanah adalah Badan Pertanahan Nasional tidak bisa melaksanakan inventarisasi dan identifikasi serta Tim Penilai Pertanahan tidak dapat melakukan penilaian atas objek tanah karena objek tanah telah digusur dan rata, sehingga tidak bisa dilaksanakan pemberian ganti rugi. Oleh karena itu, Badan Pertanahan Nasional dan Instansi terkait perlu berkoordinasi membuat peta kerja, perlu adanya penegakan hukum dan Pemerintah Harus mencarikan solusi dengan segala upaya agar masyarakat menerima ganti kerugian.Kata Kunci: Pembangunan Kontruksi; Pengadaan Tanah; Akibat Hukum
In the life of society, the law has a main objective, which is to regulate the life of society and the state in all its activities. Various community activities include social, political, and cultural activities. It is hoped that the activities carried out by the community, especially in trade, will not exceed the limits of the provisions implied in Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The purpose of this study is to analyze the business competition system in Indonesia against a business actor who is disadvantaged as a result of unfair business competition practices, whether he can file a claim for rights or a lawsuit in the form of payment of compensation through civil law enforcement procedures without first reporting in writing the occurrence of the practice to Commission for the Supervision of Business Competition (KPPU). This type of research uses library materials as secondary data and laws and regulations as a system of norms that must be obeyed and by usingan approach philosophical. Business actors who have been harmed based on Article 1365 of the Civil Code as the basis for the right to tort or Article 1239 of the Civil Code as the basis for the right to default can file a lawsuit directly to the District Court without first reporting in writing to the Business Competition Supervisory Commission (KPPU). KPPU as an institution responsible for implementing business competition law enforcement is a complementary state institution (state auxiliary organ) regardless of government influence. In practice, KPPU is an institutionas if judicial because the KPPU has the same authority as the judiciary, one of which is the authority to issue decisions and decisions.Keywords: Lawsuits, Compensation, Unfair Business Competition
Prior to the implementation of the awarding of compensation to land rights interns, a compensation deliberation procedure was carried out. In the implementation of compensation deliberations, the chief executor of land acquisition will convey the results of the assessment of the value of compensation carried out by the Land Appraisal Team (Appraisal). In the compensation deliberations, the entitled party who has not been issued only provides a way to submit an objection to the District Court. The formulation of the problem in this study is how to take legal action against land rights owners against compensation value violence and how to realize legal protection for fair land rights owners in the implementation of compensation deliberations. The type of research used in this research is normative juridical. Normative juridical research is library law research that is carried out by examining library materials or secondary data. The results of the study are legal remedies that can be taken by owners of land rights against compensation value violence, namely by submitting objections to the local district court and to fulfill legal protection of the rights of landowners and realize a sense of justice, preferably in the implementation of compensation deliberations, owners of land rights are given the right to enforce coercion in order to reach consensus on the results of the Land Assessment Team's assessment (Appraisal) and other legal remedies are needed for landowners who refuse large compensation. Suggestions in this study are that it is necessary to carry out revisions to laws and regulations regarding land acquisition and it is necessary to increase socialization to the community regarding event activities in the implementation of compensation deliberations, including also providing assistance to people who reject the results in the implementation of compensation deliberations.Keywords: Deliberation; Compensation; Fair AbstrakSebelum pelaksanaan pemberian ganti rugi kepada pemagang hak atas tanah, maka dilakukan prosedur musyawarah ganti rugi. Dalam pelaksanaan musyawarah ganti rugi, ketua pelaksana pengadaan tanah akan menyampaikan hasil penaksiran nilai ganti rugi yang dilaksanakan Tim Penilai Pertanahan (Appraisal). Dalam musyawarah ganti rugi, Pihak yang berhak yang belum sepakat hanya diberikan jalan untuk mengajukan keberatan kepada Pengadilan Negeri. Rumusan permasalahan dalam penelitian ini adalah Bagaimana upaya hukum pemilik hak atas tanah terhadap penolakan nilai ganti rugi dan bagaimana mewujudkan perlindungan hukum bagi pemilik hak atas tanah yang berkeadilan dalam pelaksanaan musyawarah ganti rugi. Jenis penelitian yang dipergunakan dalam penelitian ini adalah yuridis normatif. Penelitian yuridis normatif adalah penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder. Hasil penelitian adalah upaya hukum yang dapat dilakukan oleh pemilik hak atas tanah terhadap penolakan nilai ganti rugi, yaitu dengan mengajukan keberatan kepada pengadilan negeri setempat dan untuk memenuhi perlindungan hukum terhadap hak-hak pemilik tanah dan mewujudukan rasa keadilan, sebaiknya dalam pelaksanaan musyawarah ganti rugi, pemilik hak atas tanah diberikan hak untuk melaksanakan perundingan guna mencapai mufakat terhadap hasil penilaian Tim Penilai Pertanahan (Appraisal) dan perlu disediakan upaya hukum lainnya bagi pemilik tanah yang menolak besaran ganti rugi. Saran dalam penelitian ini adalah perlu dilaksanakan revisi terhadap peraturan perundang-undangan tentang pengadaan tanah dan perlu meningkatkan sosialisasi terhadap masyarakat mengenai kegiatan acara dalam pelaksanaan musyawarah ganti rugi, termasuk juga pemberian pendampingan terhadap masyarakat yang menolak hasil dalam pelaksanaan musyawarah ganti rugi.Kata Kunci: Musyawarah; Ganti Rugi; Adil
