It is revealed that the presence of institutional constraints precludes the full use of the potential of agricultural lands as a complete component of commodity-money relations. In view of this, the rather complicated, multifaceted problem of new institutes installation in the development of agricultural land plots market is scientifically substantiated. In this correspondence, the national vectors of influence on the introduction of the market of agricultural land plots in Ukraine have been formed and singled out, namely: trust in the authorities, stability of financial and credit institutions and the independence of the judicial branch of power. It is proved that the cancellation the moratorium on the sale of these land plots will be expedience only after the formation of institutes, which will require a certain time interval of several years.
During the analysis of legislation, regulations and their practical implementation we identified problems of maintaining the required level of environmental safety of agricultural land use. In this regard, the incentive of environmental measures implemented by economic entities in the agricultural sector is essential both by the state and through the intensification of private initiative. It is substantiated that due to the competent combination of parameters and tools of the regulator, landowners and land users will honestly comply with the requirements of environmental safety in land use. It is proposed to introduce changes to the legislation with a clear definition of the sources, grounds, procedure for compensation payments for implementation of environmental protection measures by agricultural land use entities. It is expedient to intensify the system of joint funds for restoration, reproduction and protection of agricultural lands.
Peculiarities of normative-legal provision of regulation of land relations in the context of changes to the domestic legislation are considered. The main threats facing land management specialists in planning the spatial development of territorial communities are highlighted. In addition, the features of a comprehensive plan of spatial development of the territorial community as urban planning documentation at the local level and land management documentation at the same time, as well as the concept of integrated development of the territorial community. Also, in the context of planning the spatial development of the territory and establishing restrictions on land use, the legal aspects of the functional zones of the territory proposed by the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Land Use Planning" are considered. The changes in the land legislation regarding the powers to dispose of state and communal lands, as well as the peculiarities of the use of privately owned lands have been studied. Changes to the content of the intended purpose as information of the State Land Cadastre are analyzed, taking into account changes to the regulatory support of the concept of the type of land use. The key principles of improvement and adoption of bylaws in order to harmonize the current state of regulation of land relations and future planning of spatial development of territorial communities are proposed.
Анотація. Проведено аналіз здійснення землеустрою аграрних підприємств в процесі земельної реформи. Виявлено ряд проблем, пов'язаних з недосконалістю інституційного середовища землевпорядкування й землекористування сучасних агроформувань, а саме: незавершеність економічних та правових відносин власності між власниками земельних часток та агроструктурами; зволікання з розробкою та прийняттям нормативно-правових актів, обумовлених вимогами подальшого реформування земельних відносин; катастрофічне скорочення обсягів робіт із землеустрою, спрямованих на забезпечення раціонального землекористування.Встановлено, що найважливішою серед цих проблем є відсутність науково обгрунтованої та законодавчо закріпленої Стратегії формування раціональної системи землеволодінь і землекористувань, спрямованої на створення сприятливого середовища для сталого розвитку сільських територій; ефективного функціонування сільськогосподарських підприємств; зростання ролі землеустрою в забезпеченні екологічно безпечного використання земельних ресурсів в аграрному виробництві.
The article defines the concept of public lands located both within and outside settlements. It is established that the legal regime of public lands is formed by legislative and regulatory documents that determine the rules of placement of relevant facilities, namely public buildings, and their use. It has been determined that public lands have a public use regime, but restrictions may be imposed on their use. It has been established that public lands belong to all nine categories of land and the affiliation of individual public lands to each of the land categories has been determined. Accordingly, the legal regime in different public lands differs significantly. The irrationality and inexpediency of separating public lands into a separate category of lands are substantiated. It has been established that planning documentation is an effective tool for the management of public lands, and the affiliation of such lands to one of the categories allows to determine which of the planning documents is relevant for the management of these lands. The land management, urban planning and interdisciplinary planning documentation is analysed and planning documents, the development of which is relevant and expedient for the management of public lands of certain categories of land are established. It was concluded that the formation of an integrated community space and effective management of its lands, including public use, it is important to systematically use land management and urban planning documentation on the basis of a community approved strategy.
