The cases of IUU Fishing often occurred in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels that are still fishing in Indonesian territorial and EEZ. IUU fishing caused huge losses to the country. One of the perpetrators of this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters precisely in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around Sabang waters. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study will examine more deeply related to whether the action conducted by Silver Sea 2 Vessels violate Indonesian regulation and UNCLOS 1982? And is the legal enforcement of Illegal Unreported and Unregulated Fishing taken by Indonesian government compatible with UNCLOS 1982?. This research is a normative legal research with a statute approach, and a conceptual approach. Legal material collection techniques are carried out by examining the relevant literature, analyzing various legal references relevant to the problem related to the study to be analyzed further qualitatively and descriptively. The results showed that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982 and were appropriate when this case was handled by the Sabang district court.
The problem of law enforcement against illegal fishing perpetrators in Indonesia's Exclusive Economic Zone or ZEEI needs to find a solution, especially related to imprisonment which cannot be imposed on the perpetrator. Practically, the imposition of fines also cannot be applied optimally with various existing obstacles. It is of course becomes a problem when the coastal state wants to impose a proper punishment for the perpetrators of illegal fishing in the ZEEI. In other words, when the coastal state wants to punish the perpetrators of illegal fishing, but what happens is a legal vacuum that causes the perpetrators of illegal fishing to go unpunished. The resulted of this, the perpetrators of illegal fishing in Indonesia not feeling threatened and deterred from repeating their actions. Based on this background, the focus of the problem in this study examines the urgency of alternative sanctions to imprisonment for illegal fishing perpetrators in ZEEI and alternative sanctions to imprisonment as a model of criminal sanctions policy against illegal fishing perpetrators in ZEEI. The problem approach in this study uses several approaches such as the statute approach, analytical approach, conceptual approach, comparative approach, and case approach. The results of the study shows that alternative sanctions to imprisonment as a model of criminal sanctions policy against illegal fishing perpetrators in ZEEI can optimize community services orders. The perpetrators of illegal fishing in the ZEEI must be responsible for their actions by taking immediate steps to correct the results of their actions through social work. The idea of community services orders that can be done by illegal fishing perpetrators is to actively work in marine and fishery conservation programs, such as coral reef conservation, mangrove planting, sweeping garbage in the sea or beach, and so on. This is due to the impact of illegal fishing itself which damages the environment and fishery ecosystem.
Coronavirus Disease 19Also known as Covid-19, it is a group of viruses from the Coronaviridae subfamily Orthocronavirinae and the Nidoviral order. Viruses in this group cause disease in mammals and birds, including humans. Coronaviruses cause respiratory infections in humans. Virus-hit Indonesia imposes sweeping social restrictions as an effort to break the chain of the spread and transmission of the coronavirus. With the enactment of the PSBB, the closure of various crowded places such as schools, workplaces, markets, and others also resulted in a negative impact on the community, namely an increase in the occurrence of crime. One of them is the spread of hoax news that is currently rampant in the Covid-19 pandemic. The police as law enforcement officers have the right to handle and deal with the spread of hoax news related to the prevention and transmission of the Covid-19 pandemic.
