This article is about position of village regulation in hierarchy of legislation laws after coming the law number 12 of 2011 about village regulation based on law number 10 of 2004 stated that one of the regulation in law hierarchy as long as in section 7 verse (2). Moreover, after coming the law number 12 of 2011 that changed the law number 10 of 2004 village regulation is not appear in hierarchy but still effect as in section 101 said that: “all of laws is the implication of law number 10 of 2004, it was stated that effect as long as incompatible with this law regulation”. Village regulation is also get attribution of authority law number 6 of 2014 about village. Therefore, it is clear that status of village regulation is law legislation which have the power of laws. In this autonomy, the village is given the authority to organize and manage its own so that the village regulation become important to implement the authority that to be more effective.Keywords: Village Regulation, Village Representative Board, and Hierarchy
Partisipasi politik dalam negara demokrasi merupakan indikator implementasi penyelenggaraan kekuasaaan negara tertinggi yang absah oleh rakyat. Akan tetapi, tidak semua rakyat bisa berpartisipasi secara langsung dalam politik praktis dengan cara berpihak terhadap salah satu calon, menjadi tim sukses dan mengikuti setiap kegiatan kampanye. Rakyat dalam konteks ini adalah Aparatur Sipil Negara (ASN) yang diharuskan bersikap netral. Urgensi asas netralitas ASN dalam pemilu, yaitu: a. Independensi ASN terjaga sehingga ASN terbebas dari tekanan pemangku kebijakan di luar konteks kinerja; b. ASN terbebas dari politik balas budi; c. ASN fokus mengembangkan kompetensinya untuk mendapatkan promosi jabatan; d. Asas netralitas dapat meminimalisir korupsi, kolusi dan nepotisme dalam tubuh ASN; dan e. ASN mampu menjadi abdi negara yang profesional dalam pelayanan publik. Selain itu, manajemen ASN dilengkapi dengan sistem merit melalui kebijakan dan manajemen ASN yang didasarkan pada kualifikasi, kompetensi, dan kinerja secara adil dan wajar. Penerapan sistem merit relatif efektif untuk mewujudkan the right man of the right place sehingga menimalisir nepotisme.

The presence of PPPK as a civil servant (ASN) is to increase employee resources professionally and competently so that they can keep up with the times and apply various technology applications. PPPK is also entitled to a salary and several allowances as regulated in Article 4 Section 2 of Presidential Regulation Number 98 of 2020 concerning First Personnel Salaries and Allowances. Its states that the PPPK allowance consists of: a. family allowance; b. food allowance; c. structural position allowance; d. functional position allowance; or e. other allowances.
