Toward the digital era, the marketing system is also changing from the conventional market system to the digital market system. Digital marketing has been running actively in the past decade. This transformation process does not necessarily run smoothly. There is turmoil in the marketing world both in terms of ethics and regulation. Marketplace as a digital market system is the object of this research. The object of this research becomes interesting because it examines market / trade transactions that are exist in cyberspace. Potential problems arise not only between buyers and sellers but also with Marketplace owners themselves. To explore the system from the Marketplace from the regulatory side will be further studied in this study through case studies and related legislation. In addition to getting an overview of the regulations related to E-Commerce, this research received information about the protection of personal data.
Digital transaction activities in community activities have increased due to the accelerated adoption of digitalization in Indonesia but it also has potential problems in the future such as many frauds and even crimes that often occur in cyberspace so that they tend to harm consumers or users. This research also examines the liability of Electronic System provider in regard to the system failure occurrence on online transaction. However based on the research The existence of current regulations concerning Electronic Information and Transactions in conjunction with Government Regulation Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions the liability in the case of system failure that causes losses to the other party, is not explicitly stated there are no sanctions for indemnity for Electronic System Provider the existing regulation only regulate the administrative sanction Therefore, the author suggests that electronic system provider must secure, carry out maintenance and all the efforts necessary for the electronic system to work properly to be reliable. Liability for system failures that cause harm to other parties must be explicitly stated in the Regulations
Concordia Music Shop merupakan salah satu toko alat musik yang memiliki keunikan berupa selain dari penjualan alat musik seperti toko pada umumnya, juga menawarkan jasa pemesanan dan perakitan gitar dan bass custom untuk pelanggannya. Dengan adanya kebutuhan akan media pemasaran dan sarana penjualan produk secara daring, maka akan dirancang sebuah sistem informasi e-commerce berbasis website untuk Concordia Music Shop, dimana diharapkan sistem akan mampu digunakan sebagai sarana jual beli dengan pelanggan, serta pemesanan gitar custom secara daring. Penelitian ini menggunakan metode pengumpulan data kualitatif, serta menerapkan metode SDLC Rapid Application Development (RAD) dalam proses perancangan dan pembangunan sistem. Berdasarkan hasil pengujian sistem dan pengukuran user experience, sistem yang dirancang mampu memenuhi kebutuhan Concordia Music Shop serta memiliki tingkat user experience diatas rata-rata.
Content Based Image Retrieval (CBIR) is a research cluster that is very important to overcome problems related to the image search process. The development of internet technology and data communication has caused the number of multimedia images currently circulating to be very high. This study took the Color Moment method to carry out the feature extraction process. Before the feature extraction process, a segmentation process was carried out to separate the background image and the foreground image. Next, each background and front image is stored in the database. Method performance measurement is done by calculating the value of precision and recall. The test image used is the Wang dataset consisting of ten image classes. The test results show the level of recall or completeness of the images that were found to have increased significantly after using the K-Means segmentation process. But a high enough recall value decreases the value of precision or the comparison of true images with the image found overall. Precision values decrease when compared to the CBIR method without running the K-Means segmentation.
The judge's interpretation of the novelty principle, where the Panel of Judges in industrial design disputes argues that an industrial design can be said to be new if it has undergone a significant change in visual appearance, meaning that the visual appearance of the two objects is very different. If not, then the modification of a product cannot be called new so that it cannot be considered as an industrial design. The problems of this research include: how is the regulation of product novelty in the registration of industrial designs in Law Number 31 of 2000 and how is the legal protection of designers against the concept of novelty of products in the legal system in Indonesia. This type of research used in discussing the problem of this research is normative legal research. The conclusions of this research are as follows: Regulations on Product Newness in the Registration of Industrial Designs in Law Number 31 of 2000, among others, are in Article 9. And legal remedies are contained in Article 54 of Law Number 31 of 2000. Legal protection of designers against the concept of product novelty In the legal system in Indonesia, among others: Preventive protection: This protection is also closely related to the awareness of the owner of the industrial design rights themselves to register their industrial designs in order to get protection from the State. Regressive protection for holders of Industrial Design Rights is protection that is carried out directly to resolve or overcome an event or incident that has occurred in the form of a violation of the right to industrial design. Penafsiran terhadap penerapan prinsip kebaruan (novelty) oleh hakim, dimana Majelis Hakim dalam sengketa desain industri berpendapat bahwa sebuah desain industri dapat dikatakan baru apabila telah mengalami perubahan penampakan visual yang signifikan, artinya penampakan visual kedua benda tersebut menjadi sangat berbeda. Bila tidak, maka modifikasi suatu produk tersebut tidak dapat disebut baru sehingga tidak dapat dianggap sebagai suatu desain industri. Permasalahan penelitian ini antara lain: bagaimanakah Pengaturan tentang Kebaharuan Produk dalam Pendaftaran Desain Industri pada Undang-Undang Nomor 31 Tahun 2000 dan bagaimanakah Perlindungan Hukum Pendesain terhadap konsep kebaharuan produk dalam sistem hukum di Indonesia. Jenis penelitian yang dipergunakan dalam membahas masalah penelitian ini adalah penelitian hukum normatif. Simpulan penelitian ini sebagai berikut: Pengaturan tentang Kebaharuan Produk dalam Pendaftaran Desain Industri pada Undang-Undang Nomor 31 Tahun 2000 antara lain dalam Pasal 9. Dan upaya hukum tertuang dalam Pasal 54 Undang-Undang Nomor 31 Tahun 2000.Perlindungan Hukum Pendesain terhadap konsep kebaharuan produk dalam sistem hukum di Indonesia antara lain :Perlindungan preventif : Perlindungan ini juga sangat berkaitan dengan kesadaran dari pemilik hak desain industri itu sendiri untuk mendaftarkan desain industrinya agar mendapatkan perlindungan dari Negara. Perlindungan refresif bagi pemegang Hak Desain Industri adalah perlindungan yang dilakukan secara langsung untuk menyelesaikan atau memanggulangi suatu peristiwa atau kejadian yang telah terjadi berupa pelanggaran hak atas desain industri.
