Este artigo pretende demonstrar a necessidade de adotar-se a técnica de interpretação conforme a Constituição para que a definição dos atos de improbidade administrativa por violação de princípios da Administração Pública, trazida pela nova Lei de Improbidade Administrativa, abranja condutas funcionais de agentes públicos consideradas crimes dolosos, de modo que, a um tempo só, não se desfigure a proteção conferida pela Constituição Federal à probidade e à moralidade administrativas tampouco se prejudiquem a segurança e previsibilidade jurídicas objetivadas pela nova legislação. Abstract This article intends to demonstrate, from a constitutional approach, the necessity to implement the technique known as ‘interpretation in accordance to the Constitution’ to ensure that the constitutional protection afforded to administrative probity and morality, including the protection against crimes perpetrated by public employees or administrators, does not fade away, or even does not be obliterated, especially after the recent new Brazilian Anticorruption Statute in Public Affairs has re-defined and restrained the concept of acts of misconduct in public sector which seriously violate constitutional principles of public management.
