The purpose of this article is to formulate the concept of restorative justice which balanced to protect between child offenders and the victims through the diversion (Victim-offender oriented). This goal will be realized through normative research (legal research) based on Restorative Justice concept. In Law Number 11 of 2012 concerning the Child Criminal Justice System the process (SPPA Law), its prioritizes the Diversion Process (Settlement outside the court) carried out through a Restorative Justice approach. Article 5 paragraph (2) of the SPPA Law states Restorative Justice is the settlement of criminal cases by involving perpetrators, victims, families of perpetrators /victims, and other related parties to jointly to find a fair solution by emphasizing recovery and not based on revenge. Empirical conditions show that balanced legal protection between criminal offenders and victims has not implemented. Evaluation of Law Number 11 of 2012 is needed to formulating the Integrated Child Criminal Court.
AbstrakTujuan jangka panjang yang ingin dicapai dalam kebijakan hukum pidana melalui peraturan perundang-undangan adalah memposisikan pengguna narko ka sebagai 'korban' yang membutuhkan rehabilitasi baik medis maupun sosial, bukan sebagai pelaku kriminal yang dijatuhi pidana penjara dan dimasukkan ke lembaga pemasyarakatan. Hal ini sangat pen ng mengingat data BNN menunjukan 80% pengguna narko ka adalah remaja. Provinsi Jambi sepanjang tahun 2011 menempa urutan ke-13 wilayah terbesar penyalahgunaan narko ka. Pengguna narko ka menurut Undang-Undang Nomor 35 Tahun 2009 tentang Narko ka menempatkan pelaku pengguna narko ka sebagai pelaku ndak pidana sebagaimana dirumuskan dalam Pasal 127 ayat (1) huruf a yang menyebutkan bahwa pengguna narko ka diancam dengan pidana penjara maksimal 4 (empat) tahun. Tulisan ini bersifat empiris (empirical research) berdasarkan peneli an lapangan di Pengadilan Negeri Jambi, BNN Provinsi Jambi, RSJ Jambi, dan LSM Granat. Analisis dilakukan terkait perumusan kebijakan hukum pidana dalam memandang pelaku pengguna narko ka sebagai korban ndak pidana. Data lapangan menunjukkan bahwa hampir 99% putusan hakim pengadilan negeri terhadap pengguna narko ka masih berupa pidana penjara walaupun 92% hakim pada Pengadilan Negeri se-Provinsi Jambi mengatakan bahwa pidana penjara bukan merupakan ndakan yang tepat, sementara putusan hakim merupakan gerbang utama dalam penanggulangan ndak pidana.Kata kunci: kebijakan hukum pidana, korban, narko ka, penyalahguna narko ka, rehabilitasi. AbstractThe long term goal sought a er by criminal law policy through legisla on is to put drug abusers in the posi on of vic ms in need of rehabilita ons both medically and socially, and not as criminals who have to be sentenced and sent to the jail. This shi of paradigm is important as the data from Indonesian Na onal Narco cs Board shows that out of 80% of the drug abusers are mostly teenagers; and in 2011, Jambi Province ranked 13th in Indonesia as the region with the biggest number of drug abusers. Drug abusers, according to Law Number 35 Year 2009 on Narco cs, are posi oned as criminals. As formulated in the Ar cle 127 (1) a, drug abusers are sentenced withthe maximum of 4 (four) years of prison. This is quite unfortunate since judicial verdicts should be the main gate of the criminal law preven on. Therefore, the drug abusers should be seen as vic m instead of criminals.
This research is a multi-years research that is planned to be completed in 2 (two) years. In this year this research aims to see the implementation of child offender in The Children Penitentiary Sei. Bulu Muara Bulian Jambi. This research is an "Empirical Research", that conducted field research on The Child Penitentiary Sei. Bulu Muara Bulian, and conduct interviews to Children Inmates and observations tothe implementation of the development ofthe children inmates, in addition this research also conducted on The Law and Human Rights Ministry of Jambi. The result of the research shows in The Children Penitentiary Sei. Bulu Muara Bulian Jambi not only populated by children in mates, but also combined with adult female in mates. The result of the field research on the 27 may 2015 the number ofadult female in mates reached47 (Forty-seven) people, the number ofchildinmatesare36 (thirty six) people. The results offield research hasserious problems: 1) from Goal of Development aspect ofthere isa big differences, the purpose of fosteringa child in mates are education and training while the fostering goal of adult women in mates are correctional. 2) From the practical aspectsof the available labor builder is a builder who should have the power (tupoksi) to foster in mates child obtains heavier burden than duties that are supposed, the obligation to implement the guidance to adult female in mates. 3) From the aspect of facilities there is no additional facilities relating with the increasing of the work load. 4) from the aspects of employee resources builder also there is no special addition.The head of the law Ministry and Human Rights Jambi province says the consideration of the merger because of the proximity characteristic still possible to combine. Seeing the empirical condition shows the needs for the application of Law No.11 of 2012 concerning Juvenile Justice System where the children criminals tries to avoid a child in the punishment imprison ment through the efforts diversion andrestorative justice. The research on the effectiveness of restorative justice through the application of this diversion will be continued in the research studyon the second year.
The phenomenon of rapid population growth and land conversion is what forms the background of this study. The Indonesian state does not only lose its agricultural land but also its farmers. This is the concern of the Government, including Local Governments, considering that agricultural land in its territory needs to be saved for food security and the needs of the next generations. Indonesia, including Jambi Province, will no longer have agricultural land and enough farmers in the future if this condition continues. Sungai Penuh of Jambi Province has been chosen as an object of study since this city is one of the main rice producers but suffering from agricultural land conversion. In realizing the goal, Legal policy is an option to implement because it binds not only the Local Government but also the community. That’s why it is important to protect agricultural land through a legal framework to ensure the availability of agricultural land. This article argues that the problem has to find ways by establishing local regulation to protect the sustainability of land and the prosperity of the farmers as well as by providing comprehensive incentive programs for those who conserve it.
ABSTRAK Tujuan Penelitian ini adalah untuk mengetahui dasar pertimbangan hakim dalam penerapan pidana penjara sebagai pengganti pidana denda dalam putusan kasus narkotika. Penelitian ini merupakan penelitian yuridis normatif yaitu dengan mempelajari peraturan perundang-undangan yang berlaku yang berhubungan dengan putusan pengadilan tentang tindak pidana narkotika. Hasil penelitian ini menunjukkan bahwa akumulasi antara pidana penjara dan pidana denda dalam undang-undang narkotika ini belum efektif karena dalam penerapannya pidana denda tidak pernah dibayarkan oleh pelaku. Pelaku lebih memilih untuk menjalankan pidana pengganti berupa pidana penjara. Hal ini menguatkan pendapat bahwa persoalan ini terjadi karena pidana penjara pengganti denda rendah sehingga cenderung lebih menguntungkan terpidana secara pragmatis. Disarankan pembuat kebijakan hendaknya memperhatikan efektivitas penetapan sanksi pidana denda dengan merumuskan peraturan perundang-undangan yang seimbang antara beratnya pidana penjara yang dijatuhkan dan pidana penjara pengganti denda. ABSTRACT This article seeks to analyze basis of judge's consideration in exercising imprisonment as a substitute for criminal fines in narcotics abuse case. As a normative juridical research, this study examines laws and their application to court decisions regarding narcotics crime. The results of this study demonstrates that the accumulation of imprisonment and criminal fines in the narcotics' law has not been effective to urge the perpetrator pay criminal fines. In reality, the perpetrator pragmatically prefers carrying out imprisonment to substitute sanction. The result of this research has supported the idea that the problem behind the application of imprisonment as a subtitute of fines tends to be pragmatically favourable to that of fines sanction. It is recommended that the policy-makers pay attention to the effectiveness of the stipulating criminal sanctions in the form of fines by formulating a balanced legislation between the severity of imprisonment and its substitute in the form of fines sanction.
