The increasing number of complaints from victims of cyberbullying crimes from year to year certainly requires a criminal law policy, both through penal and non-penal efforts, which are not only repressive but also preventive. The Restorative Justice (RJ) approach is one of the possible mechanisms that can be offered in order to combat this type of crime. This study aims to explain how Indonesian criminal law regulates cyberbullying and how Restorative Justice (RJ) approach concept addresses cyberbullying. This research is normative juridical research. The legal materials used were primary legal materials taken from regulations and secondary legal materials refer to relevant writings, books or research. The data is analyzed qualitatively and the writing was organized systematically and descriptively. The results revealed that the regulation on the settlement of cyberbullying includes Article 310 paragraphs (1) and (2) of the Criminal Code, Article 311 of the Criminal Code, Article 315 of the Criminal Code, Article 27 paragraphs (3) and (4) in conjunction with Article 45 paragraph (3) and (4) Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions and Article 29 in conjunction with Article 45B of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE Law), in this article cannot be applied if the action is only in the form of a threat. Even so, the concept of restorative justice is regulated in law enforcement agencies as the implementation rules have not accommodated several types of cyberbullying crimes.

<p>Tujuan dari penelitian ini adalah untuk mengetahui perbedaan dan persamaan antara kewenangan lembaga kepolisian dan lembaga Kejaksaan dalam menangani perkara pidana dengan pendekatan restorative Justice. Dewasa ini memang kedua lembaga tersebut memiliki kewenangan yang sama dalam restorative justice tetapi metode yang digunakan berbeda karena mereka memiliki payung hukum masing-masing dalam menerapkan pendekatan restorative Justice. Sedangkan metode yang digunakan dalam penelitian ini yaitu menggunakan metode yuridis normatif di mana peraturan Kepolisian Republik Indonesia dikomparasi dengan peraturan kejaksaan Republik Indonesia untuk menemukan titik temu perbedaan dan persamaan penanganan perkara pidan dengan pendekatan restorative justice. Ruang lingkup dalam penelitian ini yaitu dalam wilayah yuridis penegakan hukum lembaga kepolisian dan ruang lingkup yuridis penegak hukum lembaga kejaksaan. Hasil dari penelitian ini memiliki persamaan dan perbedaan mulai dari persamaan kewenangan dalam pendekatan perkara pidana dengan menggunakan restorative Justice, tetapi mereka memiliki perbedaan dalam hal penyelidikan dan penyidikan. Sedangkan lembaga Kejaksaan memiliki kewenangan untuk melakukan penuntutan. Kesimpulan yang dapat diambil dari penelitian ini yaitu perbandingan antara persamaan dan perbedaan penanganan perkara pidana di kepolisian dan Kejaksaan dengan pendekatan restorative Justice. Kedua lembaga memiliki kewenangan yang sama dalam restorative justice sehingga seringkali terjadi tumpang tindih dalam melakukan penegakan hukum karena kedudukan atau payung hukum yang mereka miliki memiliki kedudukan yang sama secara hierarki, Oleh sebab itu perlunya dilakukan perubahan hukum untuk menyesuaikan dengan keadaan di masyarakat.</p><p> </p>

Violation of values and norms prevailing in society is committed by adults and children as well. Violation against the law by children needs special treatment to avoid negative impact of the punishment on children's development. In addition, there is a need for legal diversion in the imposition of crimes in violation against law committed by children, including the provision of compensation to victims as a manifestation of restorative justice, which has never been carried out by courts or judges in Indonesia. This research is a normative legal research done using a conceptual approach, a statutory approach and a case approach. This research describes the object of research critically through qualitative analysis. The results of the study showed that the concept of imposing criminal punishment through future compensation can be done in the penal mediation process applied in the juvenile criminal justice system, starting from the investigation and prosecution. If the requirements that include perpetrators admitting their actions, promising not to repeat, apologizing to the victim and acting responsible and the victim is willing to accept an apology and is willing to conduct deliberation or negotiation, while community representatives also demand for deliberation, the compensation concept can be applied. Special conditions for penal mediation are applied to cases of minor qualifications. The results of the mediation agreement are attached in the case file submitted to the court. In the trial stage, the Judge can process the penal mediation in the mediation room after examining the victim, witnesses, evidence and children before hearing the demands of the Public Prosecutor.
