Penelitian ini berjudul “Keabsahan Perjanjian Pinjam Nama (Nominee) Oleh Warga Negara Asing Dalam Penguasaan Hak Milik Atas Tanah Di Indonesia”. Warga negara asing yang masuk ke Indonesia, selain bertujuan wisata juga berupaya menanamkan modal untuk usaha dengan berbagai cara, salah satunya dengan cara menguasai tanah. Cara yang dilakukan oleh pihak-pihak tertentu yang tidak berhak memiliki hak milik atas tanah, adalah dengan mengunakan perjanjian nominee atau perjanjian pinjam nama. Tujuan dari penelitian ini yakni untuk mengetahui terkait Keabsahan dan akibat hukum dari perjanjian pinjam nama (nominee) oleh warga negara asing dalam penguasaan hak milik atas tanah di Indonesia berdasarkan Kitab Undang-Undang Hukum Perdata dan Undang- Undang No. 5 Tahun 1960 tentang Peraturan Dasar Pokok- Pokok Agraria (UUPA). Penelitian yang digunakan dalam jurnal ini menggunakan penelitian hukum normatif. Perjanjian nominee yang digunakan oleh warga negara asing harus sesuai dengan syarat sahnya perjanjian dalam Pasal 1320 KUHPerdata. Perjanjian nominee tidak memenuhi unsur suatu sebab yang halal karena menyangkut pemindahan hak atas tanah dari warga negara Indonesia kepada warga negara asing secara tidak langsung, sehingga menyebabkan perjanjian nominee menjadi tidak sah. Dalam perjanjian nominee syarat objektif suatu sebab yang halal tidak dipenuhi maka mengakibatkan perjanjian tersebut menjadi batal demi hukum. Artinya dari semula suatu perjanjian dan/atau suatu perikatan dianggap tidak pernah dilahirkan/ tidak pernah ada. Kata kunci: Keabsahan, Perjanjian Nominee, dan Hak Milik.
ABSTRAKSemakin pesatnya pembangunan nasional di berbagai sektor berimplikasi terhadap terbukanya lapangan pekerjaan. Melalui ketersediaan lapangan pekerjaan ini mendorong tenaga kerja lakilaki maupun tenaga kerja perempuan untuk bekerja. Perempuan memiliki sedikit keunikan tersendiri yaitu mengalami masa haid setiap bulannya, yang mewajibkan setiap perusahaan memberikan cuti haid. Permasalahan yang diangkat dalam penulisan ini adalah Implementasi Perindungan Hukum Hak Cuti Haid Bagi Pekerja Perempuan pada PT Bali Camel Safaris's. Dalam Penelitian ini menggunakan Metode penelitian empiris. Berdasarkan penelitian yang telah dilakukan pada PT. Bali Camel Safari's, diketahui bahwa pelaksanaan pemberian cuti haid pada perusahaan tersebut belum dilaksanakan dengan baik berdasarkan Pasal 81 ayat (1) dan Ayat (2) Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Sistem penerapannya bukan dalam bentuk cuti melainkan dalam bentuk izin sakit, sehingga jatah libur setiap satu kali dalam minggu dipakai sebagai penggantinya. Hal ini hanya berlaku terhadap pekerja tetap saja, sedangkan pekerja tidak tetap tidak diberikan cuti haid sama sekali. Hal tersebut disebabkan karena ada beberapa faktor yang menjadi penghambat dalam pelaksanaan pemberian cuti haid ini yaitu, terbatasnya pekerja yang bekerja, sulitnya membuktikan benar atau tidaknya pekerja dalam masa haid serta adanya kecemburuan sosial antar pekerja terhadap pemberian cuti haid tersebut. Dalam mengatasi hal tersebut perlu adanya upaya yang Penulisan ini berjudul Implementasi Perlindungan Hukum Hak Cuti Haid Terhadap Tenaga Kerja Perempuan (Studi Pada PT. This article assesses the responsibility of local governments in Indonesia for the management of refugee care, following the enactment of Presidential Regulation No. 125 of 2016 concerning the Treatment of Refugees (the “PR”). It highlights the limited authority of local governments in handling refugee issues—which is an issue that cuts across several national legal and administrative regimes including Foreign Affairs, Human Rights, and Immigration. This article focuses on the constraints of local political dynamics and budgeting in allocating local government funds for refugee care. In addressing these concerns, the authors argue that the PR should be amended to explicitly define the role of local governments in managing refugee issues and to include the regional revenue and expenditure budget as a source of funding. In addition, the authors argue that local governments that are hosting refugees should establish relevant local regulations for implementation of the PR.
China's Social Credit System (CSC) is a reputation system adopted by the Government of the Peoples’ Republic of China that establish a mechanism of rewarding and imposing punishment to its citizen, by taking into account the behavioral performance and compliance to the law and regulation. This article aimed to reviews the concept and the scope of implementation of China’s SCS and to analyze the possibility of the Indonesian Government to adopt it into Indonesia’s legal system and legal culture. This article reflects a doctrinal legal research that collects primary and secondary sources and uses statutory, comparative, and analytical approaches. This article found that SCS basically aims at creating a comprehensive data based-system to improve the citizen's behavior based on the scoring system that entails rewards and sanctions. The widely accepted of this system by the citizen of PRC, however, does not correspond to a remaining legal issue about the lack of protection of privacy rights, particularly regarding the naming and shaming of a blacklisted person. This article suggests that Indonesia may adopt some China’s SCS aspects, including the basic idea of the upgrading of the standard of citizen behavior, the establishment of a comprehensive system that integrating all data, and partial adoption of the data analysis. However, it seems that the naming and shaming for blacklisted persons do not relevant to be adopted by the Indonesian government in the near future, in a consideration of the legal culture in Indonesia and the communal life of the Indonesian peoples.
The third Amendment of UUD 1945 in 2001 put the position of MPR is no longer as the highest state institution but equal with another state institutions. This is certainly make a legal consequence to the legal product that produced by MPR and that legal product is Tap MPR. Tap MPR is no longer regulated in hierarchy of legislation in article 7 (1) Constitution No. 10 of 2004 on the establishment of legislation because Tap MPR is not included in the general legislation. But then the issuance of Constitution No. 12 of 2011 set back Tap MPR in hierarchy of legislation because some of Tap MPR is still valid in accordance with the Tap MPR number of I / MPR / 2003 on Judicial Review Matter and Legal Status of the Tap MPR Decree from 1960-2002. If it viewed through a political perspective, it can be said that Tap MPR Decree setting tug in the hierarchy of legislation can be said to be inconsistent of legal political or unclear. Said to be inconsistent or unclear because it is not in line with changes in the MPR authority and contrary to the theory of hierarchy of norms as a result of changes in the authority of MPR must also align with the legislation and do not deserve to be above the legislation. The debate re-occurs when the authority of the Constitutional Court to review the constitutionality of MPR is considered contrary to the 1945 Constitution questionable. Is the Constitutional Court is authorized to review the constitutionality of Tap MPR towards the UUD 1945? According to the Article 24C of UUD 1945, Constitutional Court is only authorized to review legislation towards UUD 1945. There is void of norm on the authority of the Constitutional Court but on the other side, citizens who feel their constitutional rights are violated by the existence of the MPR cannot do anything. The Constitutional Court was established with the aim of legislation under the Constitution does not conflict with the UUD 1945, the next purpose is to protect and ensure the constitutional rights of citizens contained in the UUD 1945 in order not to be violated by officials or state agencies. Departed from that purpose then the Constitutional Court is authorized to review the constitutionality of Tap MPR is considered contrary to the UUD 1945.
