Penerbitan travel warning oleh suatu negara secara faktual berdampak pada tingkat kunjungan wisata ke negara yang dituju. Penelitian ini bertujuan untuk menganalisis mengenai praktik negara-negara, termasuk Indonesia, dalam menerapkan kebijakan travel warning. Selain itu, juga secara spesifik akan membahas korelasi antara kebijakan travel warning dengan eksistensi hak berwisata (right to tourism) dalam kerangka hak asasi manusia (HAM). Jenis penelitian ini adalah yuridis-normatif yang utamanya menganalisis peraturan perundang-undangan nasional Indonesia dan instrumen internasional yang relevan. Hasil penelitian ini menunjukkan bahwa praktik negara-negara dalam dalam penerbitan kebijakan travel warning menunjukkan variasi yang relatif beragam, terutama berkaitan dengan identifikasi risiko dan lembaga yang berwenang untuk menyampaikan imbauan perjalanan. Berkaitan dengan eksistensi hak berwisata (right to tourism) dalam kerangka HAM, kebijakan travel warning merupakan implementasi dari kewajiban negara untuk melindungi warga negaranya ketika mereka berada di luar negeri sekaligus merefleksikan tindakan negara untuk menjamin terpenuhinya hak-hak mendasar warga negaranya. Adapun pembatasan hak berwisata oleh negara sesungguhnya dilakukan dalam rangka menjamin terpenuhinya jenis HAM lain yang jauh lebih mendasar dibandingkan dengan pemenuhan hak berwisata yang justru masih dikategorikan sebagai HAM generasi ketiga dan eksistensinya masih diperdebatkan.The publication of travel warning by a country factually impacts the level of tourist visit to the destination country. This study aims to analyze the practice of countries, including Indonesia, in applying travel warning policy. In addition, also specifically will discuss the correlation between travel warning policy with the existence of rights of travel (right to tourism) within the framework of human rights (HAM). This type of research is juridical-normative which primarily analyzes Indonesian national legislation and relevant international instruments. The results of this study indicate that the practice of countries in the issuance of travel warning policy shows a relatively diverse variety, mainly related to the identification of risks and institutions authorized to deliver travel appeals. In relation to the existence of the right of tourism within the human rights framework, the travel warning policy is the implementation of the state’s obligation to protect its citizens while abroad while reflecting the state’s actions to ensure the fulfillment of the fundamental rights of its citizens. The limitation of travel rights by the state is actually done in order to guarantee the fulfillment of other types of human rights that are far more fundamental than the fulfillment of travel rights that are still categorized as third-generation human rights and its existence is still disputed.
Tourism is one of the world’s fastest growing industries and has been used as a vehicle for indigenous people to engage in economic development opportunities within their local communities. The concept of sustainable tourism has brought greater awareness towards maintaining the economic and social advantages of tourism development whilst ensuring the industry is both socio-cultural and environmentally sustainable. A central component to the definition of sustainable tourism is the empowerment of indigenous people to take advantage of the benefits of the tourism industry. This article will demonstrate that in certain instances there is conflict between indigenous peoples’ culture, particularly communal ownership of land and the tourism industry. This research uses comparative analysis between Bali, Indonesia and the Northern Territory of Australia to analyse the social and legal impediments, which affect the potential of local indigenous people to contribute to sustainable tourism. The conclusion drawn in this article is that both Indonesia and Australia have attempted to provide legal frameworks to promote tourism and development alongside indigenous people, however in both cases the tourism industry has not always been easily applicable to indigenous people’s concept of land ownership and communal sharing of economic assets.
This article assesses the responsibility of local governments in Indonesia for the management of refugee care, following the enactment of Presidential Regulation No. 125 of 2016 concerning the Treatment of Refugees (the “PR”). It highlights the limited authority of local governments in handling refugee issues—which is an issue that cuts across several national legal and administrative regimes including Foreign Affairs, Human Rights, and Immigration. This article focuses on the constraints of local political dynamics and budgeting in allocating local government funds for refugee care. In addressing these concerns, the authors argue that the PR should be amended to explicitly define the role of local governments in managing refugee issues and to include the regional revenue and expenditure budget as a source of funding. In addition, the authors argue that local governments that are hosting refugees should establish relevant local regulations for implementation of the PR.
Xinjiang reeducation camps are dedicated to cleanse the practice and existence of religion, and majorly subjects the Uighur moslems. China has constantly denied the conduct of gross human rights violations of Uighur moslems within Xinjiang political reeducation camps. This article will elaborate on the actions done by Xinjiang officials to unveil the gross violations of human rights towards the Uighurs within Xinjiang reeducation camps. The article will also examine the available possibility to criminally hold the perpetrators liable and provide effective relief to the victims. This article is constructed using normative legal research method with statutory, case, and fact approaches, along with conceptual/analytical approach. The result shows that there exist gross violations of human rights towards the Uighurs within Xinjiang reeducation camps in a form of arbitrary detention and torture. Moreover, there are some available possibilities to criminally hold the perpetrators liable and provide effective relief to the victims, namely through a municipal court proceeding and through the Committee against Torture.
