Sejak tahun 2015, pemerintah Indonesia terlihat gencar melakukan pembangunan infrastruktur, dan diperlukan biaya ribuan triliun memenuhi target pembangunan infrastruktur. Namun, Pemerintah hanya dapat berkontribusi sebesar 41 persen untuk pembiayaan, sehingga pemerintah akhirnya membuka peluang investasi melalui jalur Kerjasama Pemerintah dengan Badan Usaha (KPBU). KPBU saat ini dilegalisasi melalui Peraturan Presiden Nomor 38 Tahun 2015 tentang KPBU Dalam Penyediaan Infrastruktur. Berdasarkan Peraturan Presiden Nomor 38 Tahun 2015, jenis-jenis infrastruktur yang di KPBU kan ialah fasilitas publik yang menguasai hajat hidup orang banyak. KPBU berpotensi menimbulkan masalah karena aspek yang komprehensif, dan menuntut proyek infrastruktur mampu mencipta keuntungan. Melalui penelitian hukum doktriner, didapatkan bahwa terdapat kemungkinan bahwa KPBU yang diatur melalui Perpres Nomor 38 Tahun 2015 akan “mengalahkan” ketentuan dari Undang-Undang sektoral, padahal secara normatif, “yang lebih tinggi justru mengalahkan yang lebih rendah.”
Simulacra is usually known in social theory related to consumerism, or capitalist products. But in this research applied in the formation of legislation, especially the Law produced through the formation process outside the National Legislation Program. The people in this research are considered as consumers who are pressured by the simulacra produced by their thoughts, thus suppressing the reality that occurs. This study uses qualitative research with the critical theory et all. Paradigm. The approach used in this study is through social theory brought by Baudrillard about symbolic exchange. This symbolic exchange is elaborated with researchers' understanding of the formation of laws and regulations.
The importance of situational leadership practices in schools is interesting to study. The purpose of this literature review is to analyze situational leadership practices in schools. The articles used in this literature review are articles obtained using the “Google Scholar” database by entering the keyword “situational leadership”. There are several literature reviews on situational leadership in schools that were found. Based on the results of literature studies from various countries in the world, it was found that situational leadership style can develop work motivation, improve teacher performance and can increase teacher commitment to the organization.
