Police discretion by definition is the power to make decisions of policy and practice. Police have the choice to enforce certain laws and how they will be enforced. Discretion is bounded by norms (professional nor ms, community norms, legal norms, moral norms). Officers will exercise discretion in situations here the facts or people involved don not necessarily line up with the law. Discretion is exercised far more in speeding cases, vandalism, domestic violence or juvenile cases rather than homicide, rape case, thievery, robbery. Officers often feel minor offenses are more about educating citizens, whereas serious offenders deserve the full punishment of the law. If a police officer uses his/her discretionary power correctly, not only will it help the police officer in their situation, it will help the general community as well.Key words : discretion, police officer
Victim precipitation bagi korban tindak Pidana tidak dapat diartikan sebagai kontribusi korban yang menimbulkan pelaku melakukan kejahatan. Kontribusi korban dalam viktimisasi yang dialami akan membuat korban mendapat beban kesalahan yang dapat membuat korban menderita. Artikel ini memberikan pendapat yang berkaitan dengan argumentasi peranan korban yang memotivasi pelaku melakukan tindak pidana tidak dapat menjadi alasan pengurangan sanksi bagi pelaku. Pemberian pengurangan pidana dengan alasan adanya kontribusi korban dalam proses viktimisasi sangat mencederai harapan korban untuk pemidanaan yang berat bagi pelaku. Konsep victim precipitation harus dapat ditafsirkan bukan sebagai alasan pengurangan hukuman pelaku kekerasan seksual, konsep tersebut seharusnya menjadi kebijakan untuk pencegahan kekerasan seksual untuk mendapatkan cara pencegahan yang efektif.
The sustainable development goals (SDG) set peace, justice, and strong institutions with targeted access to justice for all by 2030. Goal 16 of the SDG sets the number of reports made by victims of violence to the authorities to benchmark access to justice. The study argues that there is a correlation between legal literacy and reporting of crimes. Legal literacy means awareness of a society of the legal rights and obligations and their ability to use the legal avenue to get redress. The methodology of this study is by using content and doctrinal approach. Interviews are conducted with the legal aid and human rights representatives on the society and law enforcement awareness and understanding of the legal process in CSA cases. The study shows adequate law addressing access to justice in CSA cases. The Sexual Offences Against Children Act 2017 and the Legal Aid (Amendment) Act 2017 enhanced the legal process to seek justice. However, inadequate legal literacy among the authority handling CSA is among the hindrance to justice. The absence of support from family members in lodging a police report is another issue found in the study. They were less likely to have the perceptual powers of the mind to report crimes. This study contributes to the literature on prioritising and improving access to justice in CSA.
