Akta otentik memiliki kedudukan yang sangat penting dalam lalu lintas kehidupan masyarakat, namun banyak orang yang tidak paham mengenai kedudukan akta otentik itu sendiri. Oleh sebab itu, munculnya tulisan pendek ini sebagai upaya untuk mengulas dua persoalan utama, yakni bagaimana kedudukan akta otentik serta hubungan antara akta otentik dengan hak warga negara di Indonesia. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis normatif melalui pendekatan undang-undang serta pendekatan konsep. Hasil penelitian menunjukkan bahwa akta notaris sebagai produk pejabat publik mempunyai kedudukan yang sangat kuat di Indonesia oleh karena model penyusunan akta itu sangatlah legalistik. Hal itu dilakukan demi mewujudkan hak warga negara atas kepastian hukum dan keadilan. Dengan demikian, pembuatan akta otentik sangat erat juga hubungannya dengan hak konstitusional warga negara.Authentic deeds have a very important position in the traffic of people's lives, but many people do not understand the position of the authentic deed itself. Therefore, the emergence of this short article as an effort to review two main issues, namely how the position of authentic deeds and the relationship between authentic deeds and the rights of citizens in Indonesia. This paper is carried out by referring to the type of normative legal research with the statute approach and conceptual approach and analyzed descriptively. Through this paper it has been found that the notary deed as a product of public officials has a very strong position in Indonesia because the deed compilation model is very legalistic. This is done to realize the right of citizens to legal certainty and justice. Thus, the making of authentic deeds is very closely related to the constitutional rights of citizens.
This paper explores about governor election in Aceh period 2012-2017 as a socio-political lesson. At that moment, political trends in Aceh are ongoing mass politics, not politics ideology based on the interests of the people. Mass politics is crewed politics on the basis of pragmatic and opportunist ideology. Intimidation and massive mobilization of the masses accompanied by money politics and imagery are characteristic of mass politics. In mass politics the potential for conflict is also quite high. Not often people who are victims. People admits that gubernatorial election of Aceh in 2012 was won by Zaini Abdullah and Muzakkir Manaf (Zikir) carried out by local political parties, namely the Party Aceh, the legislature is complete and the executive is entirely in the hands of the Party's control Aceh. All his potions and political teachings will be lowered to the service arena for Acehnese people during the 2012-2017 period. But the question then blocks in all of our minds, will the opposition be still dare to survive with the political dialectic recently? Of course we can see this at least in the first six months post the inauguration of Zikir as governor and deputy the governor of Aceh later.
<p>Kewenangan badan tata usaha negara tentunya harus didasari pada asas legalitas. Asas ini berlaku agar badan tata usaha negara itu tidak bertindak diluar kewenangannya, termasuk Majelis Kehormatan Notaris. Namun eksistensi Majelis Kehormatan Notaris sebagai badan tata usaha negara masih diragukan legalitasnya. Bahkan masih juga terdapat kontradiksi pemahaman menyangkut kewenangannya sebagaimana dimaksud dalam Pasal 66 ayat (1) Undang-Undang Nomor 2 Tahun 2014. Disamping itu, masih ada juga yang menyamakan prosedur kewenangan Majelis Kehormatan Notaris dengan prosedur kewenangan Majelis Pengawas Notaris. Untuk kepentingan itu, maka artikel ini sengaja ditulis sebagai upaya untuk menelaah kewenangan Majelis Kehormatan Notaris dalam perspektif hukum administrasi negara. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa Majelis Kehormatan Notaris itu memang mempunyai legalitas sebagai badan tata usaha negara dengan sumber kewenangan distribusi. Esensi dari kewenangan Majelis Kehormatan Notaris itu adalah untuk melakukan pembinaan kepada notaris menyangkut pemeriksaan dalam ranah tanggung jawab jabatan melalui kontruksi hukum administrasi dengan instrumen perizinan, bukan tanggung jawab individu melalui sarana hukum pidana. Tujuannya adalah untuk menjaga wibawa jabatan notaris dengan cara mendahulukan proses pemeriksaan dalam ranah tanggung jawab jabatan sebelum pemeriksaan tanggung jawab individu.</p>
State owned enterprises (SOEs or BUMN) companies need management which generally emphasizes governance which is more concerned with the principles of efficiency and effectiveness. In reality, it is evident that in Indonesia state-owned companies have an enormous economic and social role, and are an extraordinary force and economic driver. In Singapore and Malaysia, SOEs also contribute greatly to economic activities. In Indonesia, SOEs are included in a number of diverse sectors or fields of business, from banking, energy, food, infrastructure, and transportation, both sea, land and air. A total of 118 SOEs in 2015 with a total assets of Rp5,395 trillion would certainly be able to make a greater contribution to economic growth in 2016 if they were able to synergize in managing the business sector. BUMN assets are also estimated to be greater through the SOE asset revaluation process. The Constitutional Court in case number 48 / PUU-XI / 2013 and case No. 62 / PUU-X1 / 2013 dated May 22, 2013 decided that management BUMN must use the principle of Business Jugment Rule. In the ruling, it was also stated that state owned finances were state finances. As a result, this ruling brings legal certainty about the position of finance of BUMN. This paper explains that the development of BUMN (state owned enterprises-SOEs) as a corporation that carries out social and business missions is facing constitutional juridical problems and facing the challenges of globalization. Factually, at this time legal development cannot be separated from the influence of globalization. Globalization in the economic field has affected various fields of the business sector in the world.
The application of the Business Judgment Rule (BJR) in the United States has also been increasingly tightened by the necessity of carrying out the duties and authority of directors based on the principle of prudence and efforts to fulfill proper information (transparency and fully disclosure) before the directors take action or decision. In a number of countries, the Business Judgment Rule (BJR) doctrine has been used quite extensively in their legal systems. One of them is in the United States. Basically there are two concepts applying the provisions applied by the American Law Institute (ALI). Second, the provisions that took place in the Delaware court. These provisions have been adopted by several courts. Overall, the Business Judgment Rule and fairness standard are separate research standards used by the court, and one does not feel confused with one another. The Business Judgment Rule analysis does not include a fair analysis, because the duty of care does not require unauthorized transactions to be the object of court examination concerned with fairness standards, only the director acts in good faith, with caution with an information base for that interest , and it does not violate wisdom.
