The land is one of the most valuable items because it is a source of life and livelihood for humans. The land has economic value and spiritual value for the owner. However, as the community's need for land increases, so does the legal problem in acquiring land. Everyone will disagree with one another in defending their land rights. One of them is ownership disputes that occur in inherited land which are the object of the transfer of land rights to other parties, for example through buying and selling. There are several phenomena of legal problems due to the sale and purchase of inherited land which is carried out unilaterally by one of the heirs and / or several heirs. Therefore, in this paper, we will discuss some problem formulations, namely: (1) What is the position of the sale and purchase of land over inherited land without the consent of all heirs? (2) What are the legal consequences of buying and selling land on inherited land without the consent of all heirs? Through normative juridical study, the following results are obtained. First, the legal act of buying and selling inherited land without the consent of all heirs is an illegal act before the law. Secondly, the legal consequences of buying and selling land on inherited land without the approval of all heirs are null and void.
AbstrakSecara yuridis-formal, tegas ditentukan, bahwa setiap perjanjian mempersyaratkan adanya kata sepakat para pihak. Meski demikian, implementasi piranti normatif itu tidak semudah bunyi tekstualnya. Dengan menggunakan metode analisis yuridis, tulisan dengan tema "Kata Sepakat Dalam Perjanjian dan Relevansinya Sebagai Upaya Pencegahan Wanprestasi", mengangkat dua permasalahan menarik. Pertama, bagaimana relevansi kata sepakat dalam perjanjian sebagai upaya mencegah wanprestasi; Kedua, bagaimana format ideal pemenuhan kata sepakat dalam perjanjian. Temuan dalam penelitian ini memastikan, bahwa: Pertama, kata sepakat merupakan kata kunci dalam menjamin terlaksananya dan terpenuhinya janji-jani para pihak dalam perjanjian. Oleh karenanya, dalam perjanjian pada umunya, kata sepakat mempunyai relevansi untuk mencegah terjadinya wanprestasi. Kedua, secara ideal, dalam setiap perjanjian perlu dipastikan, bahwa para pihak benar-benar memahami apa yang disepakati baik secara formal maupun secara material (substansial). Through a juridical approach, writing with the theme "Agree to the Agreement and its Relevance as a Prevention of Default", raised two interesting problems. First, how is the relevance of the agreement in the agreement as an effort to prevent default; Second, what is the ideal format for agreement in an agreement. The findings in this study confirm, that: First, the agreement is the key word in ensuring the implementation and fulfillment of the promises of the parties to the agreement. Therefore, in agreement in general, the agreement has relevance to prevent defaults. Second, ideally, in every agreement it is necessary to ensure that the parties truly understand what has been agreed both formally and materially (substantially).
Era industri 4.0 mendukung perkembangan sistem bekerja secara Remote Working. Dengan berbagai sistem yang ada, hubungan kerja yang timbul antara Pemberi kerja dan Pekerja dimulai dengan adanya Perjanjian Kerja. Secara fakta, Perjanjian kerja yang seringkali memgalami permasalahan di Indonesia adalah PKWT. Remote working dalam PKWT yang dilakukan melalui media elektronik tentunya harus dilihat dari berbagai aspek hukum, yaitu: KUHPerdata, UU Ketenagakerjaan dan UU Cipta Kerja sebagai pembaharuannya, serta UU ITE. Oleh karena itu, penulisan ini akan menguraikan beberapa hal yaitu: Pertama, bagaimana pola PKWTdengan konsep Remote Working dalam prespektif UU Cipta Kerja?; Kedua, bagaimana keabsahan PKWTdengan konsep remote working dalam prespektif UU Cipta Kerja?. Dengan menggunakan metode penelitian yuridis normatif dapat diuraikan bahwa PKWT dengan konsep remote working pada prinsipnya jg harus tunduk pada UU Ketenagakerjaan dan UU Cipta Kerja. Selain itu, terdapat beberapa aspek hukum yang harus diperhatikan oleh para pihak dalam perjanjian kerja sehingga keabsahan perjanjian kerja dapat terpenuhi dan dapat melindungi hak dan kewajiban masing-masing pihak.
Customers who failed to make promises in bank financing have the potential to cause disputes. To solve this, there are already a series of regulations that govern. The problem is that there are still many customers who feel disadvantaged in the dispute resolution process. The purpose of this study was to find out how the procedure for resolving financing disputes with guaranteed mortgage rights at Bank Jatim as well as any obstacles in the dispute resolution process. This study uses empirical research methods with a regulatory approach. The results of the study show that the dispute resolution process in non-litigation has not been maximized and the tendency is to execute the object of collateral. While the constraints are in non-compliance with the process of fostering customers who are injured in the promise, and the auction process that takes a long time.
Land Registration is a very important issue because it is the beginning of the birth process of proof of ownership of land rights. It is important that the land registration issue so that the country needs to issue legislation governing land registration activities throughout Indonesia. Departing from such a requirement, this paper presents three points as the material of the discussion. First, how is the legal basis of land registration at the beginning of independence? Second, how the institutional land registration in early independence; and third how the existence of land registration position in the early days of independence? Through normative and juridical studies,the obtained explanation as follows: Land registration in the early days of independence has not to change Dilaksankan by the registration position due to the law in the religious field that has not been in form. To fill the void of law still enforced based on Article II of The Constitution of the Republic of Indonesia in 1945. Further, the law was formed Number 7 of 1958 about the transition of duty and agrarian authority to officials from the Ministry of Agrarian.
