The present study is initiated by the proliferation of a very broad authority of Regional Government in forming Regional Regulation that is not in line with the synchronization and harmonization function of optimal legislation. Each party has a strong argument in maintaining a regulation on religion. As a result, it contributes to a multi-interpreted, conflicted, and disobedient legal situation to the law that finally creates disharmony between one rule and another. A normative legal research is the type of the present study. It accentuates a literature study with the focus on the study of the principles of law, systematic system of law, legal study and legal history. A descriptive research is also included in the present research. The conclusion that can be seen from the present is that, first, decentralization of tourism management after the Constitutional Court Decision Number 137/PUU-XIII/2015 gives an authority to Regional governments in legal products making with a very broad extent. The present study expects a change in the substance of Regional Regulation of West Nusa Tenggara Province Number 2, 2016 concerning Halal Tourism and it is hoped that Regional Government of the Regencies/Cities in West Nusa Tenggara Province will immediately issue the Regional Regulations so that the maximum contribution of tourism to Regional Ownsource Revenue in sports and leisure venue levies sectors can be achieved.
<p align="center"><strong><em>Abstract</em></strong></p><pre><em>This paper discusses the legal politics of </em><em>mineral and coal mining, as well as the authority of the goverment in managing the natural resources of mineral and coal mining.</em><em> Mineral and coal mining is a non-renewable natural resource, so for the sake of sustainability the government's role in management, coaching and supervision is needed</em><em>. Major Changes occured since the enactment of law No. 23 of 2014 on Regional Goverment which regulates the distribution of goverment affairs.</em><em> The existence of the Law makes the authority of the management of mineral and coal mining in the Regional Government of Regency or City to be abolished</em><em><br /> This research is a prescriptive legal research with a legal approach and a conceptual approach.</em><em>This paper is a presciptive legal research with approach of law and conceptual approach. The technique of collecting legal materials in this paper is literature study. The technique of analysis of legal materials used is the method of deduction. Pertambangan mineral dan batubara merupakan sumber daya alam yang tidak dapat diperbaharui, sehingga demi keberlangsungan diperlukan peran pemerintah dalam hal pengelolaan, pembinaan dan pengawasan. Perubahan besar terjadi sejak diberlakukan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, yang mengatur mengenai pembagian urusan pemerintahan. Keberadaan Undang-Undang tersebut membuat kewenangan pengelolaan pertambangan mineral dan batubara di Pemerintah Daerah Kabupaten/ Kota menjadi hapus. Penelitian ini merupakan penelitian hukum yang bersifat preskiptif dengan pendekatan undang-undang dan pendekatan konseptual. Teknik pengumpulan bahan hukum studi pustaka dan teknik analisis bahan hukum metode deduksi. Hasil tulisan ini menyimpulkan adanya disharmonisasi antara peraturan perundangan sektoral dengan UU Pemda 2014 dan adanya konsekuensi hukum terhadap pemberlakuan UU Pemda berupa (i) perubahan kelembagaan; (ii) serah terima personil, pendanaan , sarana dan prasarana, dan dokumen (P3D); (iii) perubahan peraturan perundang-undangan.</p><em>Kata kunci: politik hukum, pertambangan mineral dan batubara, undang-undang nomor 23 tahun 2014 tentang pemerintahan daerah.</em>
<p>Abstrak<br />Artikel ini bertujuan untuk menganalisis tentang pemajuan hak atas kesehatan reproduksi bagi perempuan narapidana di Lembaga Pemasyarakatan Klas IIA Sragen.Narapidana adalah seorang yang telah melakukan suatu perbuatan pidana yang sedang menjalani proses pidananya, walaupun telah melakukan suatu pelanggaran hukum narapidana juga mempunyai suatu hak asasi yang harus di lindungi oleh pemerintah. Akan tetapi pelaksanaan hak terhadap Narapidanaperempuan di Lembaga Pemasyarakatan Klas IIA Sragenbelum terlaksana dengan baik dan optimal. Kesehatan reproduksi adalah bagian dari satu kebutuhan terhadap kesehatan yang merupakan hak dasar setiap individu baik laki-laki maupun perempuan.Perempuan di lembaga pemasyarakatan mempunyai resiko lebih besar di banding laki-laki untuk terkena penyakit organ reproduksi.Penelitian Hukum ini menggunakan pendekatan yuridis empiris,Penelitian ini bersifat deskriptif analisis yaitu penelitian yang mendeskripsikan suatu data kemudian menganalisa data yang di kumpulkan berdasarkan penemuan yang ada di lapangan. Hasil Penelitian ini adalah bahwa perempuan narapidana di Lembaga Pemasyarakatan Klas IIA Sragen belum terpenuhi akan hak kesehatan reproduksi nya,terdapat faktor penghambat terhadap pemenuhan hak kesehatan reproduksi bagi narapidana perempuan di lembaga Pemasyarakatan Klas IIA Sragen, antara lain: Anggaran belum memadai, SDM:kekurangan tenaga kesehatan missal nya dokter khusus kandungan ataupun bidan, belum ada ahli gizi dalam menentukan angka standar gizi, belum ada nya juru masak yang ahli di bidang memasak makanan, Sarana: fasilitas gedung yang belum layak untuk perempuan, ibu hamil dan menyusui.Pemajuan hak atas kesehatan reproduksi perempuan narapidana di Lembaga Pemasyarakatan Klas IIA Sragenbelum terpenuhi dan masi mengalami berbagai kendala.</p><p>Kata Kunci : Kesehatan reproduksi, perempuan Narapidana, Lembaga Pemasyarakatan.</p>
<p align="center"><strong><em>Abstract</em></strong></p><p><em>This article examines the implementation of the fulfillment of the right to health services for woman prisoners in a state of pregnancy (case study of women’s class IIB Yogyakarta). This research is legal (judicial) normative, namely by reviewing library materials (literature study). Therefore, the data used in this research is secondary data, which includes the pimary legal materials,secondary, and tertiary. The results of this study indicate that every pregnant female prisoners is fulfilled her right to obtain health service in class IIB Yogyakarta of Goverment regulation number 32 year 1999 due to the existence of monitoring and evaluation by head of womens’s prisoners class IIB Yogyakarta in order to minimize any barriers that occur in the implementation of the fulfillment of the right to health services for woman who are pregnant.</em></p><p><strong><em>Keywords : </em></strong><em>implementation of the fulfillment of rights; female prisoners; health services</em></p><p align="center"><strong>Abstrak</strong></p><p>Artikel ini mengkaji tentang pelaksanaan pemenuhan hak atas pelayanan kesehatan bagi perempuan narapidana dalam keadaan hamil (studi kasus Lembaga Pemasyarakatan Perempuan Kelas IIB Yogyakarta). Penelitian ini merupakan penelitian hukum (yuridis) normatif, yaitu dengan mengkaji bahan-bahan pustaka ( studi kepustakaan). Karena itu, data yang digunakan dalam penelitian ini adalah data sekunder, yang mencakup bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa setiap narapidana perempuan yang sedang hamil dipenuhi haknya untuk memperoleh pelayanan Kesehatan di Lembaga Pemasyarakatan Perempuan Kelas IIB Yogyakarta sesuai dengan pasal 20 ayat (1) Peraturan Pemerintah Nomor 32 Tahun 1999. Karena adanya monitoring dan evaluasi oleh Kepala Lembaga Pemasyarakatan Perempuan Kelas IIB Yogyakarta sehingga dapat meminimalisir segala hambatan yang terjadi dalam pelaksanaan pemenuhan hak atas pelayanan kesehatan bagi perempuan yang sedang hamil.</p><p><strong>Kata kunci : </strong>pelaksanaan pemenuhan hak; narapidana perempuan; pelayanan kesehatan</p>
For the modern state, the constitution must be understood as a development concept. The constitution can not be viewed as a static document, but it lives and grows as the basic principle of the state organization that always followes the developments and dynamics of society. The constitution was born from constitutionalism which provides limits of state power in one side and guarantee for the rights of people through constitutional provisions in another side. During 74 years of Indonesia's independence, the constitution give the color in the organization of state administration. Many important events woven in 3 (three) constitutions in this period, namely the Constitution of 1945, the Constitution of 1949 United Republik of Indonesia and Provisional Constitution of 1950. Departing of the view that the constitution should follow the development and dynamics of society, this paper will explore the journey of life about the constitution of the early independence to this present era. For a dynamic society, creation of awareness constitution is very important, because the constitutional talks in the future will increasingly contentious and polemical as in previous years.
