La Cantalera is an accumulation site for fossil vertebrates consisting mainly of teeth and isolated postcranial remains. It has the greatest vertebrate biodiversity of any site from the Hauterivian-Barremian transition in the Iberian Peninsula. Up to now, 31 vertebrate taxa have been recognized: an osteichthyan (Teleostei indet.), two amphibians (Albanerpetonidae indet. and Discoglossidae indet.), a chelonian (Pleurosternidae? indet.), a lizard (Paramacellodidae? indet.), four crocodylomorphs (cf. Theriosuchus sp., Bernissartiidae indet., Goniopholididae indet., cf. Lisboasaurus sp.), two pterosaurs (Istiodactylidae? indet., Ornithocheiridae? indet.), four ornithopod dinosaurs (Iguanodontoidea indet., Hadrosauroidea? indet., "Hypsilophodontidae" indet., Rhabdodontidae? indet.), a thyreophoran (Polacanthidae indet.), a sauropod (Euhelopodidae indet.), eleven theropods (Carcharodontosauridae? indet., Baryonychinae indet., aff. Paronychodon sp., Maniraptora indet. 1-3, Dromaeosaurinae indet. 1-3, Velociraptorinae indet., Avialae? indet.) and three or four multituberculate mammals (Cantalera abadi, Eobaatar sp., Plagiaulacidae or Eobaataridae gen. et sp. indet., "Plagiaulacida" indet.). La Corte de Distrito de La Haya dictó el 5 de febrero de 2020 una sentencia sobre el Sistema de Indicación de Riesgos (SyRI), por la que considera que: i) es lícito utilizar instrumentos de este tipo siempre que exista un interés público que lo justifique y se tomen las medidas adecuadas para garantizar la mínima injerencia necesaria en el derecho a la privacidad; y ii) que la implementación de SyRI no ofrece garantías suficientes como para considerar que este sistema en concreto respeta el necesario juicio de proporcionalidad que debe superar toda injerencia en la privacidad de acuerdo con el artículo 8 del Convenio Europeo de Derechos Humanos (CEDH). A lo largo de este trabajo reflexionaremos en detalle sobre las consideraciones de la Corte en esta sentencia en relación con el respeto a la privacidad, la obtención masiva de datos y la opacidad con que funcionan los algoritmos de análisis de datos masivos.
The health and genetic data of deceased people are a particularly important asset in the field of biomedical research. However, in practice, using them is compli- cated, as the legal framework that should regulate their use has not been fully developed yet. The General Data Protection Regulation (GDPR) is not applicable to such data and the Member States have not been able to agree on an alternative regulation. Recently, normative models have been proposed in an attempt to face this issue. The most well- known of these is posthumous medical data donation (PMDD). This proposal supports an opt-in donation system of health data for research purposes. In this article, we argue that PMDD is not a useful model for addressing the issue at hand, as it does not consider that some of these data (the genetic data) may be the personal data of the living relatives of the deceased. Furthermore, we find the reasons supporting an opt-in model less convincing than those that vouch for alternative systems. Indeed, we propose a normative framework that is based on the opt-out system for non-personal data combined with the application of the GDPR to the relatives’ personal data.
