The objective of the present study was the retrospective analysis of the cases of rapid diagnostics of the HIV status of the corpses referred to the pathologo-anatomical departments of Moscow. The standard statistical methods were used for this purpose. The structure of H IV infections is described in terms of age and sex of the affected subjects as well as stages of the disease. It was shown that cooperation of forensic medical services with AIDS control and prevention centres is of primary importance for the substantiation of the diagnosis, improvement of the quality of the relevant statistical information about the causes of death, enhancement of the objective value of epldemiological data on the occurrence of HIV infection and HIV-associated diseases in the city of Moscow.
Исследуется необходимость квалификации степени тяжести вреда, причиненного здоровью человека бездействием лиц, обязанных оказывать помощь больному в соответствии с действующей формулировкой статьи 124 Уголовного кодекса Российской Федерации. Отсутствие у судебно-медицинских экспертов нормативно определенных критериев оценки степени тяжести вреда, причиненного здоровью в результате бездействия лица, обязанного оказывать помощь больному, создает сложности прав применения статьи 124 УК РФ в действующей редакции. Указанная проблема требует дальнейшего изучения и возможного принятия единого нормативно-правового закрепленного решения с целью применения унифицированного подхода к судебно-медицинской оценке «бездействия». The authors consider the necessity of determining the severity of harm inflicted to human health by the inaction of the officials and other persons responsible for rendering assistance to a patient in accordance with article 124 of the Criminal Code of the Russian Federation. The absence of the normative formulation of the forensic medical criteria for the assessment of the degree of the harm to human health as a result of inaction of the subjects responsible for rendering medical aid creates difficulties for the enforcement of article 124 of the Criminal Code of the Russian Federation in its present wording. This problem awaits further studies for the possible adoption of the uniform normative and regulatory documents for the consistent application of the definition of inaction with reference to the assessment of not rendering medical assistance.
This article describes the specific features of the action of the biological damaging factors on the human organism associated with the explosive injury. Both the direct action of the damaging agents contained in the biological weapons and their secondary effects in the form of systemic and local infectious complications of the inflicted wounds are considered. The criteria for the evaluation of the degree of harm to the health of the victims of explosion attributable to the action of the biological damaging factor are proposed.
The objective of the present study was to develop the classifying criteria for the evaluation of the severity of the harm inflicted to human health that resulted in the development of mental disorders in response to subsequent HIV infection. The analysis of the available information about a rise in the prevalence of HIV infection and the high frequency of associated psychic disorders among the infected subjects gave evidence of the importance of this problem and the necessity to improve the existing statutory and legislative basis underlying the regulation of activities in this field. The scientifically substantiated criteria for the expert assessment of the severity of the harm to human health are proposed taking into consideration the clinical manifestations of psychic disorders.
Цель исследования-провести постатейный анализ Кодекса административного судопроизводства Российской Федерации в части, касающейся судебно-экспертной деятельности, для ознакомления читателя с новым направлением работы судебномедицинских экспертов в судах. Показано, что некоторые нормы КАС РФ не проработаны со специалистами или не согласованы с другими нормативными актами по аналогичным и смежным вопросам. Поэтому положения Кодекса, касающиеся деятельности судебных экспертов, должны быть широко обсуждены заинтересованной общественностью с целью выработки рекомендаций для законодательной коррекции некоторых статей.
