Paham radikal berbasis agama (SARA) kerap kali dianggap sebagai cikal bakal berbagai aksi terorisme di Indonesia. Faktanya sejarah mencatat berbagai beberapa kejadian yang dapat digolongkan sebagai aksi teror terjadi di Indonesia beberapa tahun terakhir. Menyikapiperkembangan kejahatan terorisme di Indonesia, pemerintah melakukan upaya dengan mengeluarkan regulasi berupa Perpu No. 1 Tahun 2002 yang disahkan menjadi undangundang No.15 Tahun 2003 tentang Pemberantasan tindak Pidana Terorisme. Sanksi Pidana diterapkan terhadap para pelaku terorisme yang tertangkap, namun keberadaan pihakpihak dengan paham radikal tersebut tetap saja menjadi momok menakutkan bagi masyarakat. Selain upaya berupa penerapan sanksi pidana (penal) pemerintah juga perlu menerapkan upaya non penal untuk melengkapi kekurangan-kekurangan dari upaya penal yang dilakukan.Kata Kunci: Kebijakan Hukum Pidana, Non Penal, Penanggulangan, Terorisme.
Abstrak:Â Kebutuhan masyarakat terhadap kendaraan bermotor semakin meningkat seiring dengan meningkatnya kebutuhan sarana transportasi. Kondisi ini dimanfaatkan oleh lembaga konsumen dengan cara membuat perjanjian baku dengan klausul yang ditentukan secara sepihak. Menurut Pasal 1338 ayat (3) KUHPdt, setiap orang diperbolehkan membuat perjanjian dengan siapapun dan tentang apapun sepanjang memenuhi syarat yang ditentukan dalam peraturan perundang-undangan, dan kepatutan dalam masyarakat. Penggunan asas kebebasan berkontrak ini akan dapat merugikan pihak konsumen, untuk melindungi konsumen, maka harus dilakukan dilakukan pembatasan-pembatasan. Salah satu pembatasannya adalah asas itikad baik, namun demikian asas itikad baik tersebut dalam hukum positif di Indonesia belum dirumuskan secara jelas dan pasti.Kata Kunci: kebebasan berkontrak, itikad baik, perlindungan hukum konsumen.Â
The diversity of Indonesian society is an invaluable national asset. Nowadays, the diversity faces threats from exposure to radicalism. Social media is used for hate speech, which is motivated by differences in ethnicity, religion, race, and groups. Acts of terrorism conducted based on hatred towards specific religious communities. Pancasila as the nation's view of life must be the basis in various state policies against radicalism. Therefore, this study will discuss two issues, namely the exposure of radicalism against diversity in Indonesia and the existence of Pancasila in encounter with this threat. The conclusions of this paper are: First, radicalism that developed in Indonesia mainly based on religious reasons. This radicalism realized in various acts of terrorism. The idea of radicalism mainly implanted to the younger generation in the age range of 17-24 years. Second, as an effort to encounter radicalism based on Pancasila, countermeasures based on an educational approach must be implemented. Re-internalization of Pancasila values must perpetrate through educational institutions since preschool education and implanted by families.
Supervision of child protection was legitimized within Policy of the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali. In this study, there are two issues that will be examined namely how is the implementation of the Bali the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali and how are the efforts being made to overcome obstacles in the protection and fulfillment of children's rights in Bali? This research uses the theory of the Van Metter and Van Horn Implementation Model. The research method used is to use a qualitative approach. Data analysis in the study was carried out interactively using interactive models from Miles and Huberman. The results of the study concluded that the implementation of the Bali Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali has not been effective in fulfilling and protecting children's rights. Regional Child Protection Organizing Commission has not been able to optimally carry out its duties as a supervisor of the implementation of child protection in the Province of Bali. Efforts are being made to overcome obstacles in the protection and fulfillment of children's rights in Bali by establishing communication and coordination and making a joint commitment in the form of an MoU with several parties organizing child protection in the Province of Bali. Pengawasan terhadap perlindungan anak di Provinsi Bali dilegitimasi melalui Gubernur Bali membentuk Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali melalui Kebijakan Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali. Dalam penelitian ini, terdapat dua permasalahan yang akan dikaji yakni bagaimanakah implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali dan bagaimanakah upaya yang dilakukan untuk mengatasi kendala dalam perlindungan dan pemenuhan hak anak di Bali? Penelitian ini menggunakan teori Model Implementasi Van Metter dan Van Horn. Metode penelitian yang digunakan adalah mempergunakan pendekatan kualitatif. Analisis data dalam penelitian dilakukan secara interaktif dengan menggunakan model interaktif dari Miles dan Huberman. Hasil penelitian menyimpulkan bahwa implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali belum efektif dalam memenuhi dan melindungi hak anak. Komisi Penyelenggara Perlindungan Anak Daerah belum bisa optimal dalam melaksanakan tugasnya sebagai pengawas pelaksanaan perlindungan anak di Provinsi Bali. upaya yang dilakukan untuk mengatasi kendala dalam perlindungan dan pemenuhan hak anak di Bali adalah dengan membangun komunikasi dan koordinasi serta membuat suatu komitmen bersama berupa MoU dengan dengan beberapa pihak yang menyelenggarakan perlindungan anak di Provinsi Bali.
Indonesian geographical, geological and hydrological regions are disaster-prone areas. Disaster-prone is the geological, biological, hydrological, climatological, geographical, social, cultural, political, economic and technological conditions or characteristics of a region for a certain period of time that reduce the ability in preventing, reducing, achieving readiness, and reduce the ability to respond to adverse impacts of certain hazards. People's behavior that damages the environment also tends to increase the number of disasters. Seeing such conditions, the government has compiled a policy to allocate budgets for pre-disaster, during emergency response, and post-disaster development. This government policy is also supported by the contributions of community in providing disaster relief. A bad disaster management system can be a gap to commit criminal acts against funds and disaster relief. In this study, two issues will be discussed, namely legal politics in funding and managing disaster relief and the legal consequences of criminal acts in funding and management of disaster relief. The legal politics in disaster relief funding and management are outlined in The Act Number 24 of 2007 concerning Disaster Management and Republic of Indonesia Government Regulation Number 22 of 2008 concerning Funding and Management of Disaster Assistance. The legal consequences of criminal acts of funding and management of disaster assistance are criminal penalties ranging from imprisonment, fines, or capital punishment
