Abstract. Nowadays the understanding of the institute of marriage and its importance in the society has changed. Marriage is no longer assumed to be a commitment for a lifetime. As the principle of equality has replaced hierarchy as the guiding principle of family law it gave more grounds for family disputes and it became socially acceptable to leave marriages that are intolerable or merely unfulfilling. The aim of this article is to suggest an alternative dispute resolution method-mediation as a worthy option for resolving family conflicts.
Sport performs several functions in society: an educational, a social, a cultural as well as a recreational function. Nevertheless, sport is also a business: in economic terms, it is a rapidly growing area accounting for 3% of world trade and is one of the sectors most likely to generate new employment in the near future (Colucci & Hendrickx, 2014). For that reason, at the present stage of sustainable development of sports in Europe in general and in Republic of Latvia in particular, there is a growing need for a clear regulation of the employment relations of professional athletes and transparency of taxation in the sports industry. Taking these considerations into accounts, aim of the research paper is to assess the theoretical and practical issues related to employment relationships and taxation in Latvian sports from the sustainable development perspective. The methodological basis of the research consists of general scientific and special legal research methods.
The practical significance of the Doctoral Thesis is expressed as a set of practical insights which formulates proposals for the use of ADR methods in Latvian sports disputes proposing specific amendments to the Sports Law. The developed research is the only study on ADR in sport of this scale in Latvia. Neither sports law as a branch of law, nor disputes between parties thereto and types of such disputes have been studied, hence this research may also be used as a basis for further development of the sports law at national level and may lead interested parties to better understanding of the nature of sports disputes, their types and suitable extra-judicial ways to resolve them.
