The state in carrying out the life of the nation and state faces threats that come from within the country and abroad. This study aims to find out the legal rules regarding shooting to death for perpetrators of criminal acts of terrorism in the perspective of the principle of the presumption of innocence, where this case has always been a hot issue in Indonesia, especially when we associate shooting to death or being shot on the spot for perpetrators of criminal acts of terrorism with the principle of presumption of innocence. This research is normative in nature with reference to existing books, journals, and laws and regulations. There are several legal rules that form the basis for doing so/shooting death against terrorism crimes are: Article 48 of the Criminal Code, In Article 49 paragraph (1) of the Criminal Code, In Article 51 of the Criminal Code paragraph (1), National Police Chief Regulation Number 8 of 2009 concerning Implementation of Human Rights Principles and Standards. The principle of presumption of innocence also places him in the Burden of Proof or the burden of proof and it is the duty of the public prosecutor to prove the defendant's guilt, unless the proof of Insanity is imposed on the defendant or the law provides strict provisions for reverse proof. The application of the principle of presumption of innocence must also always uphold human rights that must be respected by everyone.
In today's era, humans prioritize systems and business, but along with Islamic progress, Sharia-based economy and business are now starting to develop. To meet daily needs, transportation is currently the urgent need for everyone. This is because transportation can support all activities in the community. This type of transportation too affects the rotation of activities that can be utilized in the economic sector, delivery of goods or services, and passenger transportation. This study aims to analyze the position of online ojek based on the perspective of Islamic law. Looking at the current development of the Islamic economy, many do not follow Islamic law in economic and business development. In this case, a compelling case for research is the development of the online transportation business. This study uses the normative juridical method. In normative research, to obtain data, you must use secondary data sources or library data and abuse laws and Hadith, or Al'qur'an as a writing reference. So, from the discussion, we can see that online transportation service companies have succeeded in achieving Sharia business principles. This is all proven by economic progress and has created community welfare.
Sexual crimes always develop across time and era, as well as what is felt and becomes a hot issue in these years, namely sexual crime which has begun to spread and develop among academics or among universities in Indonesia, where universities should be a strong foundation in terms of educating. generation of the nation, now Universities have only become terror and disaster for victims of sexual harassment, most of whom are students, and it is not unmitigated that the perpetrators of the crime of sexual harassment themselves are none other than him who has an important role and power, both Leaders, Lecturers, and officers and public service personnel at the Higher Education. That is why Ministerial Regulation No. 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education is here to serve as a solution and a common source of confusion for universities in Indonesia.
