The research objective was to substantiate the concept of sports law as an independent branch of Russian law. Using the induction method, the authors analyzed the general approaches to understanding any branch of law. They believe that, at the present stage, sports law can be considered a complex branch of law. The systemic-structural method made it possible to present sports law not only through its subject and method, but also through sources, principles, and other attributes. Some of the positions expressed in the scientific publications were questioned by the methods of critical analysis. They used the comparative legal method to analyze the positive foreign experience. As a result, they obtained an authentic concept of sports law. They also defined the groups of social relations, their general characteristics, interpretation method, the concept of sports legal relations, etc. The field of sports legislation needs legal codification. A Sports Code of the Russian Federation would be a logical solution to the problem. It should unite the positive experience of foreign countries. Sports law is a complex branch of Russian law. Its subject is relations in the field of physical culture and sports. This branch of law uses both dispositive and imperative methods. The newly developed system of sources of sports law requires systematization, improvement, and legal codification. The results obtained can be used to expand the scientific understanding of sports law and as a material for lawmaking.
The article is focused on the analysis of the statutory legal acts of Altai Krai for physical training and sports from the standpoint of compliance with the rules of legislative technology. The authors note that there is no single abridgement of such rules, and this, in particular, is the cause of many technical defects in the legislation. Therefore, the position of those researchers who propose to pass a special act is supported, which would enshrine in law the proper requirements and rules of legislative technology. The study has considered the criteria often mentioned by researchers in the relevant literature.Some of them are: compliance with the distribution of the jurisdiction of the Russian Federation and the subjects of the Russian Federation established by the Constitution of the Russian Federation, lack of excessive duplication of federal legislation, provision of consistency, completeness and detail of legal regulation, present norms regulating relations with reference to regional specificity. The analysishas been applied to: Act of Altai Krai of 11.09.2008 N 68-ЗС «On Physical Training and Sports in Altai Krai» and Statutory Order of Altai Krai Administration dated 04.03.2011 N 100 «On the Strategy for the Development of Physical Training and Sports in Altai Kraifor the Period up to 2020».Overoll, they have received a positive assessment, both in terms of content and writing technique. Yet some problems have been identified. An inconsistency with the distribution of the jurisdiction of the Russian Federation and the constituent entities of the Russian Federation established by the Constitution of the Russian Federation has beennoted, and a proposal has been formulated to exclude the corresponding provision from the regional act. There has been revealed the presence of duplications of federal legislation that do not carry amessage. Examples of norms with their detailed analysis have been given, where the consistency, completeness and detail of legal regulation are not provided. Proposals have been formulated to expand the provisions aimed at addressing issueswith reference to regional specificity.
The article examines the legal status of cryptocurrencies in Russia. The authors study the civil and criminal law aspects of this phenomenon. The legislation does not define the legal status of cryptocurrencies, while the theory of law and court practice have not yet worked out a unified approach to it. The authors present an overview of the existing positions regarding this issue and suggest that cryptocurrency should be regarded as other property. It is stated that whatever position is incorporated into law, in real life cryptocurrency is in global circulation and has a great potential. As for criminal law, the authors show that it is relatively independent from civil law when dealing with issues within its object. It is suggested that, for the purposes of criminal law, the available instruments should be adjusted to enable a prompt reaction to the crimes committed at the present moment. The authors analyze the possibility of recognizing cryptocurrencies as an object and instrument of committing crimes within the framework of current legislation. Using the examples different crimes, the authors demonstrate that cryptocurrency could act as an instrument of committing them. It is also stated that cryptocurrency could be recognized as an object of some crimes. To support their position, the authors present such arguments as crimes of terrorism, illegal trade in drugs and psychoactive substances, economic crimes and some others. They also discuss cryptocurrency as an object of theft. It is proven that there is a practical necessity to recognize cryptocurrency as an object of theft. Criticism of this approach by some researchers is also discussed. The authors, however, show that it is possible to solve this problem positively. They conclude that current Russian and foreign legislation should be amended and should define the legal status of cryptocurrencies; however, the goal of criminal law could and should be achieved even before these amendments are adopted.
