Nomor 4 Tahun 2009 tentang Minerba meningkatkan konsekuensi kerusakan lingkungan dan berdampak pada terpinggirkannya perlindungan hukum bagi rakyat kecil yang karena keterbatasan melakukan usaha pertambangan tanpa izin yang diancam sanksi pidana sesuai Pasal 158. Artikel ini didasarkan metode penelitian hukum empiris sosiologis untuk mendapatkan data primer melalui observasi dan wawancara di 6 desa berbeda kecamatan yang ditetapkan secara purposive. Penegakan hukum pertambangan tanpa izin di Kabupaten Kuningan lebih bersifat persuasif kompromis, belum berdampak secara signifikan terhadap fungsi lingkungan karena berkurangnya tekanan penduduk. Perlu dilakukan pemberdayaan hukum kepada mereka agar dapat menggeser mata pencahariannya ke sektor pariwisata & kuliner. Kata kunci: fungsi lingkungan; pertambangan ilegal; penegakan hukum.
Population Growth, technology and interaction with the society has been grown up hedonism for example like using handphone, wearing jewelry, driving vehicle, until land tenure in Kanekes / Baduy colony that previously had ascetic culture. There is a tendency between the legal culture and applicable legal system. The moral principles that were adopted began to be ruled out aside like Baduy Tangtu, rather open than Baduy Penamping and vividly by Baduy Dangka who became a mualaf or married with the local. In the beginning of 2004, Baduy society yet had around 850 Ha area that had been brought from the local with the average of ownership of each person around 1-2 Ha. Meanwhile, Urang Tangtu & the Jakarta begin to overwhelm the land in absentee method which is violated by national agrarian law and Kanekes village regulation. In Lembah Brokah & Landeuh village which is fostered by YASMUI and At-Taubah 60 Foundation, Baduy mualaf obtained waqf from them whom prersuade other parties to purchase the land around Kanekes Village to cultivated with profit sharing system.

Cloning can be abused as a commodity of goods that can be traded for the benefit of organ transparency, labor, similarity of figures as well as other exploitative acts rather than as a whole person who is feared to be Destroying human dignity so that it is necessary to immediately create strict rules about human cloning.

Agricultural profit land-sharing agreement is one of customary law which still exist and widely implemented among the village community in Indonesia. Majority people of Leuwidamar, Bojongmenteng and Cisimeut Village are engaged in farming and many of them use profit land-sharing system to carry out farming activities. The government obliged the implementation of this agreement has to be written through Act No. 2/1960 for purpose of cultivators justice. In fact, the implementation of the agreement is done with verbal based on customary law. The government needs to give socialization periodically to villagers regarding the obligation of law to held agricultural profit land sharing in writing. Low educational level and lack of economic prosperity leads to the existence of agricultural profit land-sharing agreement consistently evolve the village.
