Ketidakadilan suami yang berpoligami dalam memberi nafkah adalah salah satu macam permasalahan dari ketentuan hukum Islam terhadap ketidakadilan suami dalam berpoligami dan bagaimana pertimbangan hakim Mahkamah Syariah Bentong Pahang dalam memutuskan perkara cerai gugat Kasus Mal Nomor 04300-076-0217 tentang ketidakadilan suami dalam berpoligami sebagai alasan cerai gugat. Di dalam penelitian ini, penulis menggunakan metode kajian pustaka dengan sumber sekunder yaitu putusan hakim yang berkaitan secara langsung bertempat di Mahkamah Syariah Bentong, Pahang. Manakala sumber primer yaitu sumber yang mampu atau dapat memberikan informasi atau data tambahan yang dapat memperkuat perbahasan data yang diambil penulis dalam skripsi ini adalah buku-buku standard, kitab-kitab dalil dan hadist, al-Quran dan Enakmen Undang-Undang Keluarga Islam di Malaysia. Hasil dari penelitian ini menunjukkan bahwa pandangan hakim dalam memutuskan perkara Ketidakadilan Suami yang berpoligami antaranya adalah tergugat telah lalai dalam pemberian nafkah kepada penggugat dan anak-anak, tergugat tidak adil dalam berpoligami dan tergugat tidak menjalankan tanggungjawabnya sebagai seorang suami berdasarkan dalil-dalil Hukum Syarak dan Undang-Undang Keluarga Islam maka, Mahkamah mengabulkan permintaan tergugat. Oleh karena itu, seorang laki-laki yang poligami harus adil dalam materi atau lahiriah, karena untuk hal tersebut dapat dikelola dengan baik dan normal oleh suami yang poligami, seperti pengaturan nafkah lahiriah, yakni kebutuhan sandang, pangan, papan, termasuk pengaturan waktu gilir.
Online sirri marriage is a marriage which is organized through skype or other social media without documentation from the marriage registration council. So far, the practice of online sirri marriage in Indonesia is very apprehensive and to be serious problem in the society. It happened because the regulation that control marriage which is stated in law (UU) of marriage and compilation of Islamic law tend to be ignored. The requirement of the guardian (Wali) as regulated by Islamic law is ignored. However, the online sirri marriage is organized by involving marriage celebrant (penghulu) as magistrate guardian (wali hakim) who married off which is not detected by the woman's parents, her guardian, and marriage registrar. The practice of online siri marriage is performed by using skype media and other social media that the face of penghulu and the two brides can be seen directly. The consequences that will arise are uncertainty of law and law protection, especially for women and children who could not claim their rights when family conflict occurred. This kind of marriage is legal (sah) when it is implemented in accordance with the rules and prerequisites in Islamic law. However, the phenomenon of sirri marriage which is performed arbitrarily contradicts the Islamic law, because the completeness one of the pillars of marriage that is involvement of guardians is not fulfilled as well as many mafsadah occurs. In addition, online sirri marriage is also not recognized by the state, because it could not be proven by the marriage certificate.
This study is about Jerusalem in the Bible and Al Quran based on eschatological paradigm (theology/philosophy), which uses two approaches: sociology (geographical and anthropological history analysis) and interpretation (hermeneutical analysis and bil ma'tsur interpretation). Jerusalem is the name of the Holy City of the Abrahamic Religions. This region has been controlled by a number of empires with different geographical boundaries and names over a long period of time. For the Jews, Jerusalem is claimed as the Promised Land. Through a search of several versions of the Bible, a number of commentaries and the main sources (Muslim priests and intellectuals), this study shows eschatologically that Jerusalem in the Bible is not a particular regional name (to a certain extent) but the contextualization of God's Kingdom (saved, renewed earth, harmonious and peaceful). The contextualization of God's Kingdom has something in common with the concept of the promised earth (khilafah) in the Qur'an, as the contextualization of dar as salam, the nickname for countries (dayyar) conquered and claimed to be harmonious and peaceful. In other scenarios of the future, the Kingdom of God and the Caliphate (the promised earth) probably include locations around the Al-Aqsa Mosque that we recognize today.
Al-Qur'an in Islam is God's guidance to all humans at all times and throughout the world whose contents must be understood and practiced. To better understand the content and meaning of the Qur'an, a study of the interpretation of the Qur'an is very necessary in order to know the message of Allah behind the texts. The study of the Qur'an actually always experiences a fairly dynamic development, along with the development of socio-cultural conditions and human civilization. This is evidenced by the emergence of works of interpretation, ranging from classical to contemporary, with various styles, methods and approaches used. Bint ash-Syati' is the first female interpreter to live in contemporary times, through language interpretation with a philological and literary approach, which she initiated tries to apply examples of interpretation and apply them in people's lives. It is hoped that the study of the interpretation model will be able to provide a sharper and more specific picture of the method model in question. ABSTRAK Al-Qur’an dalam Islam merupakan petunjuk Allah kepada seluruh manusia di segala zaman dan seluruh dunia yang isinya harus dipahami dan diamalkan. Untuk lebih memahami isi dan makna Al-Qur’an, kajian tafsir Al-Qur’an sangat diperlukan guna mengetahui pesan Allah di balik teks-teksnya. Kajian Al-Qur’an sebenarnya selalu mengalami perkembangan yang cukup dinamis, seiring dengan perkembangan kondisi sosial-budaya dan peradaban manusia. Hal ini terbukti dengan munculnya karya-karya tafsir, mulai dari yang klasik sampai kontemporer, dengan berbagai corak, metode dan pendekatan yang digunakan. Bint asy-Syati’ adalah penafsir perempuan pertama yang hidup di zaman kontemporer, melalui penafsiran bahasa dengan pendekatan filologi dan sastra yang digagasnya mencoba mengaplikasikan contoh-contoh penafsiran dan mengaplikasikan dalam kehidupan masyarakat. Kajian model penafsiran tersebut diharapkan akan dapat memberikan gambaran yang lebih tajam dan spesifik yang dimiliki oleh model metode dimaksud
