implementing enhanced cooperation in the area of jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes. It concludes that the new EU arrangement has made it easier for spouses to determine the applicable law and evaluates the suitability of the connecting factors provided by Regulation 2016/1103. The paper also challenges the examination of these connecting factors as of the time of the conclusion of the marriage and assumes that their exclusion under exceptional circumstances is difficult to achieve. It compares the connecting factors with those provided by Slovenian and Croatian private international law in theory, and provides practical examples of the differences resulting from the new European arrangement. The paper further examines the hypothesis that the possibility of agreement on the choice of law will cause many problems in practice, and provides possible solutions. Throughout the paper, the system established by Regulation 2016/1103 is compared with other European regulations and the relevant case law of the CJEU, but the author primarily focuses on the changes in Slovenian and Croatian case law caused by the application of Regulation 2016/1103.
In 2019, the EU Member States started applying the Matrimonial Property Regulation, which concerns the property regimes of international marriages. This regulation is aimed at helping couples manage their property and divide it in case of divorce or the death of one spouse. One of the main features of this regulation is its openness to the parties’ choice. The parties are enabled – in cases foreseen in the regulation – to grant jurisdiction to the court of a Member State of their choice, as well as to choose the law applicable to their matrimonial property regime. Since this regulation is new and the track record of its application is rather short, the limits of party autonomy allowed under the regulation and its advantages still involve a high degree of uncertainty. This article provides an in-depth analysis of party autonomy as provided for in the Matrimonial Property Regulation. In addition, it scrutinises the issue of party autonomy in the Succession Regulation, which often directly interacts with the Matrimonial Property Regulation.
Provisional measures can be of utmost importance to creditors especially in relationships with a cross-border element. The Regulation 1215/2012 is the legal source that provides rules regarding the jurisdiction to issue a provisional measure but also offers imperfect provisions regarding the recognition and enforcement of foreign provisional measures issued in the other Member States of the European Union. Due to the inadequate regulation, CJEU case law has played an important role, but nevertheless, the article finds and opens new questions that have not yet been answered.
Los Reglamentos gemelos sitúan la “autonomía de las partes” como principal factor de conexión para el establecimiento de la ley aplicable. De este modo, se presume que las partes (tenderán) a concluir un acuerdo sobre la elección de la ley. Sólo posteriormente los Reglamento gemelos prevén la posibilidad de determinar la ley aplicable en ausencia de elección de las partes. En la práctica, sin embargo, la realidad es diferente. Aunque los acuerdos sobre el régimen económico matrimonial son cada vez más populares, la mayoría de las parejas, incluso las transfronterizas, siguen sin celebrar un acuerdo sobre la elección de la ley. Por lo tanto, este documento comienza con los factores de conexión, para decidir sobre la ley aplicable en ausencia de tal acuerdo, y las normas supletorias que tienen un valor importante a la hora de determinar y aplicar una ley relevante. A continuación, pasa a los requisitos del acuerdo de elección de ley de las partes, en el que examina los factores de conexión pertinentes, los requisitos relativos a la validez formal y material del acuerdo y sus efectos sobre terceros. El documento termina con un estudio de caso en el que se muestra que la decisión de la pareja por una forma específica de su relación puede tener consecuencias de gran alcance.
