The role of islamic financial system in Indonesia has been shown to support the creation of higher economic development, and also support the establishment of a more stable financial system, to achieve the well-being of individuals and society. The entry of islamic financial system in Indonesia made a new breakthrough in the syari'ah capital market. One of the products of syari'ah capital market is syari'ah mutual fund. Syari'ah mutual funds are contributors in the field of Syariah Economic Law. The development of sharia economic finance in Indonesia to date still in line with the business model. This is due to the development products of market-driven syari'ah financial system in fulfilling demand in the real sector. Syari'ah financial institution have not been so familiar in the midst of Indonesian society due to the new condition, is something reasonable if not widely known then syari'ah financial institution still lose many consumers than conventional financial institutions. Implementation of the transaction contract should not be contrary to the islamic Syari'ah, whether prohibited because forbidden in addition to the substance, which contains tadlis, ihtikar, ba'i najasy, garar, and usury, an because unauthorized, i.e. the order and conditions. Oral testament is an example of a nonintellectual type of transfer of rights that frequently causes problems in the community. Factors that frequently develop as a result of heirs' unhappiness with the inheritance distribution. Oral testaments are governed by numerous rules, one of which being the Compilation of Islamic Law (KHI), which is based on Presidential Instruction Number 1 of 1991. This is a normative work that uses descriptive research methods. The following are the findings: first, according to KHI, the legal status of the oral testament in the distribution of inheritance has legal certainty in the national testament's laws. Second, the use of oral testaments in inheritance distribution under the KHI must meet the requirements outlined in Articles 194 and 195 of the KHI. Third, according to KHI, the legal consequences of oral testaments in the distribution of inheritance can be valid if the conditions are met and otherwise invalid if the conditions are not met, with other consequences such as testament cancellation, revocation, and prohibition of things that are prohibited in the implementation of the technique occur.
Midwife is a profession, so in its implementation in addition to basing on service standards set by laws and regulations, it must also be subject to a code of ethics established by professional organizations (Article 24 paragraph Idan i2 of the health law). So that a midwife as one of the health workers must not only be responsible to the community based on laws and regulations, but also human rights are responsible to professional organizations (midwifery) on the basis of the midwife's code of ethics. Responsibilities based on the government-invitation regulations as legal responsibilities can be divided into 3 aspects, namely, aspects of civil law, aspects of criminal law and aspects of administrative law. This thesis raises the issue of how criminal liability for malpractice committed by midwives and what efforts can be made to prevent malpractice from occurring by midwives. The accountability of the criminal act of malpractice is currently an important highlight because the rule of law that regulates it is still vague. This is because the regulation regarding the qualifications of malpractice acts is not clearly stated in the rule of law, this act of malpractice cannot be seen from one scientific point of view alone, but in terms of legal science as well. Malpractice contains criminal and civil elements, this should be considered so that each party does not give their own interpretation according to their respective sciences. The factors causing this criminal act of malpractice are still confusing. On the one hand, the perpetrator of malpractice cannot be blamed considering that his actions were done to solve a problem but his actions do not guarantee the completion of the problem. That Law number 36 of 2009 concerning health is not sufficient to regulate the crime of malpractice, in the Criminal Code it is also not found about the qualifications of malpractice acts that are found only qualifications due to the act of malpractice. For this reason, according to the author, the regulation regarding the criminal act of malpractice must be in good form in terms of the quanaification of malpractice acts, the consequences of malpractice acts and the accountability of the perpetrators of malpractice crimes.
Perceraian yang terjadi akan menimbulkan konsekuensi terhadap anak yang lahir dari pernikahan. Kompilasi hukum islam telah mengatur akibat hukum yang terjadi karena perceraian. Pasal 105 dan 156 Kompilasi Hukum Islam menjelaskan bahwa ibu adalah orang yang lebih berhak memegang hak asuh anak dibandingkan ayahnya. Hakim dalam Putusan Nomor 007/Pdt.G/2019/PA.Gdt telah memutuskan bahwa pengasuhan anaknya jatuh pada ayahnya. Hal ini menimbulkan pertanyaan bagaimana implementasi Kompilasi Hukum Islam dalam hal hak asuh anak pada Pengadilan Agama tersebut dan apa dasar pertimbangan hakim dalam menjatuhkan putusan tersebut serta akibat hukum yang timbul dari putusan tersebut.Proses penelitian ini peneliti menggunakan desain penelitian deskriptif analisis dengan menggunakan jenis penelitian Pustaka. Pendekatan yang digunakan dalam penelitian adalah Pendekatan Normatif. Sumber data yang digunakan dari bahan hukum primer, sekunder, dan non hukum. Pengumpulan data dari informan terkait di Pengadilan Agama Pesawaran. Analisis dilakukan dengan cara sistematis yaitu dengan mengklasifikasikan dan menafsirkan data sesuai dengan penelitian. Penarikan kesimpulan dilakukan dengan menggunakan metode Deduktif.Hasil dari penelitian ini menunjukan bahwa penerapan Kompilasi Hukum Islam di Pengadilan Agama Pesawaran dalam hal hak asuh anak tidak serta merta digunakan melainkan lebih mengutamakan kepentingan anak tersebut. Hakim mempertimbangkan putusan berdasarkan fakta-fakta hukum yang timbul dipersidangan. Akibat hukum yang timbul dari putusan tersebut yaitu terhadap hubungan suami istri maka bagi suami yang mentalak istrinya dengan talak satu raj’i wajib memberikan nafkah mut’ah, makan dan kiswah serta masih berhak terhadap istri yang ditalak selama masa iddah, sedangkan akibat hukum terhadap hak asuh anak yang jatuh pada ayah maka baik ibu maupun ayah wajib memberikan kasih sayang dan menjamin terpenuhinya kebutuhan anak-anak tersebut. Pangan merupakan kebutuhan dasar manusia yang paling utama sehingga harus tersedia, dan terjangkau oleh daya beli masyarakat. Pelaku usaha pangan dalam melakukan produksi pangan harus memenuhi berbagai ketentuan mengenai kegiatan atau proses produksi pangan. Masyarakat juga perlu mendapatkan informasi yang jelas terkait dengan asal, keamanan, mutu, kandungan gizi, dan keterangan lain dalam kemasan terhadap setiap produk yang akan dibeli ataupun dikonsumsi. Penelitian ini membahas tentang kesadaran hukum pelaku usaha keripik singkong dalam labelisasi produk olahan pangan yang sesuai dengan Undang-Undang Nomor 69 Tahun 1999 tentang Label dan Iklan Pangan, kendala yang dihadapi pelaku usaha keripik singkong dalam labelisasi produk olahan pangan, dan upaya Badan Pengawas Obat dan Makanan (BPOM) dalam meningkatkan kesadaran pelaku usaha keripik singkong dalam labelisasi produk olahan pangan. Desa Sumamukti Kecamatan Way Tuba Kabupaten Way Kanan masih banyak yang belum menyadari pentingnya labelisasi guna Perlindungan Konsumennya. Penelitian ini adalah penelitian normatif empiris, objek penelitian ini adalah Pelaku Usaha Keripik Singkong di Desa Sumamukti Kecamatan Way Tuba. Upaya meningkatkan kesadaran pelaku usaha keripik singkong dilakukan oleh Sanitarian Penyelia (Kesling) dengan cara memberikan penyuluhan dan sosialisi tentang labelisasi produk olahan pangan dan upaya pengawasana agar produsen/pelaku usaha benar-benar memenuhi kewajiban sesuai ketentuan labelisasi produk olahan pangan.
