Perdagangan orang merupakan kejahatan transnasional. Tahun 2019, KPPA mencatat 213 kasus dan meningkat menjadi 400 kasus pada tahun 2020. Kondisi ini mewajibkan negara mengambil tindakan tegas untuk melindungi warga negara khususnya perempuan dan anak agar tidak terjebak dalam perdagangan orang. Tujuan penulisan artikel ini adalah untuk menganalisis peran organisasi internasional dan regional dalam mengatasi persoalan perdagangan orang, peran pemerintah dan aparat penegakan hukum dalam penyelesaian tindak pidana perdagangan orang di Indonesia serta upaya perlindungan kepada korban perdagangan orang. Penelitian ini menggunakan metode penelitian yuridis normatif dengan kajian kepustakaan. Bahan hukum primer yang digunakan adalah Undang-Undang Nomor 21 Tahun 2007 Tentang Tindak Pidana Perdagangan Orang (TPPO). Hasil penelitian menunjukkan bahwa IOM dan ASEAN telah melakukan berbagai upaya untuk penanganan perdagangan orang melalui fasilitasi pembuatan regulasi, diplomasi antar negara transit dan negara tujuan, koordinasi antar kementerian dan kepolisian untuk penindakan secara cepat dan tepat. UU TPPO tidak menimbulkan efek jera karena memberikan sanksi rendah. Pemerintah Indonesia harus lebih meningkatkan upaya pencegahan dan perlindungan terhadap korban, serta menetapkan hukuman yang dapat menjerakan pelaku.
Human resources play a critical role in a company's development and achievement of its objectives. Workers' quality and morale suffer as a result of managers' failure to pay attention to their requirements and expectations. Human resource management and development are expected of organizations. The purpose of this study is to assess and analyze the impact of rewards and punishment on employee performance. The approach of purposeful sampling is used to choose samples from a number of organizations that match the criteria. The study's data was gathered through the distribution of questionnaires to respondents. Using the SPSS version 25 program, process this study data by testing the hypothesis and performing multiple linear analyses to determine the outcomes. This discovery proved that the reward and punishment variables had a favorable and significant impact on employee performance, both partially and concurrently. This study relies on primary data gathered from 60 respondents from three companies who completed questionnaires. Researchers employed two independent factors and one dependent variable to assess employee performance. Based on the study's findings that reward and punishment have a positive and significant effect when used together, they have a significant value of 0.000 0.05 and a calculated value of 15.500 > Ftable 3.16. As a result, it may be stated that reward and punishment have a considerable impact on employee performance. While reward and punishment have a 35.2 percent coefficient of determination on employee performance, the remaining 64.8 percent is influenced by variables that were not evaluated.
This paper aims to analyze the process of forming the Draft Law on the Elimination of Sexual Violence (RUU Elimination of KS) from the perspective of Islamic law and analyze the political configuration in the formation of the law. The method used is descriptive analysis with the type of normative-empirical research. This method is considered able to answer all the main problems in this study. The results show that, in Islamic law a leader is obliged to maintain the soul, mind, dignity and worth of his people. Islam does not justify violence against women, Islam commands that every human being can give love and affection to women without violence as stated in QS. Ar-Rum (30): 21. To prevent sexual violence against women and uphold moral values, the leader must form a regulation as a form of responsibility from a leader to his people. These regulations must be obeyed and implemented by all his people, this is explained in (QS. An -Nisa, (04); 59. In the formation of the Draft Law on the Elimination of KS, there was a tug of war. Since 2016 until now, the Bill on the Elimination of KS has been in and out of the National Legislative Council (Prolegnas) however, until now it has not been ratified for various reasons given until it was clashed with religious beliefs The ratcheting up of the ratification of the KS Abolition Bill shows the reluctance of the legislature to provide legal protection to the public.Abstrak: Tulisan ini bertujuan untuk menganalisis proses pembentukan Rancangan Undang-Undang tentang Penghapusan Kekerasan Seksual (RUU Penghapusan KS) ditinjau dari perspektif hukum Islam dan menganalisis konfigurasi politik dalam pembentukan Undang-Undang tersebut. Metode yang digunakan adalah analisis deskriptif dengan jenis penelitian normatif-empiris yang dianggap mampu menjawab semua pokok permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa dalam hukum Islam seorang pemimpin wajib menjaga jiwa, akal, harkat dan martabat dari rakyatnya. Islam tidak membenarkan adanya kekerasan terhadap perempuan, Islam memerintahkan agar setiap manusia dapat memberikan kasih dan sayang kepada perempuan tanpa adanya kekerasan sebagaimana tertuang dalam QS.Ar-Rum (30):21. Untuk menjaga agar tidak adanya kekerasa seksual terhadap perempuan dan menjunjung tinggi nilai moralitas, maka pemimpin harus membentuk suatu peraturan sebagai bentuk tanggung jawab dari seorang pemimpin kepada rakyatnya. Peraturan tersebut wajib dipatuhi dan dilaksanakan oleh semua rakyatnya, hal ini dijelaskan dalam (QS. An-Nisa, (04);59. Dalam pembentukan RUU Penghapusan KS terjadi tarik ulur. Sejak tahun 2016 hingga saat ini, RUU Penghapusan KS telah berapa kali keluar masuk Prolegnas, namun sampai saat ini belum kunjung disahkan dengan berbagai alasan yang diberikan sampai dibentrokan dengan keyakinan agama. Tarik ulur pembahasan RUU Penghapusan KS menunjukan, keengganan dari badan legislatif dalam memberikan payung hukum kepada masyarakat.
<p>This article examines the experience of Acehnese female victims of sexual violence seeking justice through Qanun Jinayat (Islamic criminal bylaw) in Aceh, Indonesia. The empirical data in this study were collected through in-depth interviews with the victims and families related to the cases of sexual violence. By employing the narrative agency, this article argues that telling the experience of seeking justice is a way female victims of sexual violence express their resistance to the implementation of Qanun Jinayat in Aceh. Regarding this, we will show that Aceh’s Qanun Jinayat, which was originally implemented to eradicate sexual violence, turns out to have limitations in realizing the desired goals. This finding ultimately confirms that the concept of legal pluralism adopted in Aceh, Indonesia, has liminality in facilitating justice for women and other marginalized communities.</p>
